Abstract

Dengan adanya pandemi saat ini yaitu Covid-19 yang banyak menyebabkan terjadinya pemutusan hubungan kerja (PHK), Pemutusan hubungan kerja adalah berakhirnya kontrak kerja seorang pekerja dengan perusahaan, sehingga tidak ada lagi hak dan kewajiban yang harus dipenuhi. Namun, dengan adanya upaya yang dilakukan oleh Pemerintah dengan berbagai kebijakan sehingga dapat dilakukan pencegahan agar Pemutusan hubungan kerja dapat dihindari, Sehingga para pekerja/buruh tidak kehilangan pekerjaan dan perusahaan juga tidak mengalami kebangkrutan. Keadaan pandemi saat sudah banyak sekali membuat pekerja/buruh kehilangan pekerjaan sehingga membuat kehidupan semakin sulit. Dalam penulisan skripsi ini menggunakan metode penelitian normatif yang bersifat normatif kualitatif, dengan menggunakan teori tujuan hukum dan teori negara hukum, sedangkan jenis data yang digunakan penulis adalah kepustakaan, data sekunder melalui dokumen-dokumen, buku-buku yang saling terkait, jurnal yang relevan, dengan tujuan untuk memperoleh bahan-bahan hukum. Hasil penelitian menunjukan bahwa perusahaan dapat melakukan pemutusan hubungan kerja di masa pandemi Covid-19, dengan dapat membuktikan bahwa mengalami kerugian akibat pandemi Covid-19. Dan Pemerintah telah membuat berbagai kebijakan yang dapat mencegah terjadinya pemutusan hubungan kerja di masa pandemi Covid-19./ With the current pandemic, namely Covid-19 which causes many layoffs (PHK), Termination is the end of a worker's work contract with the company, so there are no more rights and obligations that must be fulfilled. However, with the efforts made by the Government with various policies so that prevention can be done so that termination of employment can be avoided, so that workers/laborers do not lose their jobs and the company does not go bankrupt. The current state of the pandemic has made a lot of workers/labourers out of work, making life even more difficult. In writing this thesis using normative research methods that are normative qualitative, using the theory of legal objectives and state theory, while the type of data used by the author is literature, secondary data through documents, interrelated books, relevant journals, with the purpose of obtaining legal materials. The results of the study show that companies can terminate employment during the Covid-19 pandemic, by being able to prove that they have suffered losses due to the Covid-19 pandemic. And the government has made various policies that can prevent layoffs during the Covid-19 pandemic.
