Abstract

Munculnya e-commerce memberikan dampak, salah satunya adalah mengenai jaminan dari keamanan bertransaksi dan privasi pengguna jasa jual belionline. Sehingga banyaknya permasalaahan penyalahgunaan data pribadi yang sering terjadi maka dapat kita lihat bahwa lemahnya sistem perlindungan dari e- commerce yang menyebabkan penyalahgunaan data pribadi karena kurangnya sistem keamanan dalam pengawasan. Berdasarkan hal tersebut maka penulis merumuskan masalah adalah bagaimana perlindungan hukum bagi konsumen ataspenyalahgunaan data pribadi dalam jual beli online? Dan bagaimana penyelesaian hukumnya jika terjadi perselisihan antara para pihak atas penyalahgunaan data pribadi konsumen dalam jual beli online? Metode penelitian yang penulis gunakan adalah yuridis normatif, dimana penelitian yang dilakukan untuk melindungi data pribadi konsumen dalam penggunaan transaksi elektronik. Jenis data yang penulis gunakan dengan meneliti bahan pustaka atau data sekunder, primer dan tersier. Hasil dari penelitian yang penulis dapat adalah pengaturan mengenai perlindungan data pribadi yang ada di Indonesia tersebar di beberapa peraturan perundang-undangan dimana perlindungan hukum terhadap penyalahgunaan data pribadi diatur dalam Undang-Undang No. 19 Tahun 2016 tentang Perubahan atasUndang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik./ The emergence of e-commerce has an impact, one of which is about the guarantee of the security of transactions and the privacy of users of online buying and selling services. So that the many abuses of personal data that often occur, we can see that the weak protection system from e-commerce that causes misuse of personal data due to the lack of security systems in surveillance. Based on this, the author formulated the problem is how is the legal protection for consumers for them issue of personal data in online buying and selling? And what is the legal settlement if there is a dispute between the parties over the misuse of consumer personal data in online buying and selling? The research method the authors use is normative juridical, where research is conducted to protect consumers' personal data in the use of electronic transactions. The type of data that the author uses by researching library materials or secondary, primary and tertiary data. The result of the research that the author can have is the arrangement regarding the protectionof personal data in Indonesia spread acrossseveral laws and regulationswhere legalprotection against the misuse of personal data is regulated in Law No.19 of 2016 concerning in law No. 11 of 2008 on Information and Electronic Transactions.
