Abstract

Pandemi Covid-19 yang melanda Indonesia diawal tahun 2020 berdampak pada ekonomi sehingga banyak perusahaan harus merumahkan pekerja bahkan melakukan Pemutusan Hubungan Kerja (PHK). Situasi pandemi tersebut digunakan perusahaan bahwa keadaan pandemi Covid-19 merupakan keadaan memaksa atau force majeure. Penelitian ini mengambil rumusan masalah yaitu apakah pandemi Covid-19 dapat dikategorikan sebagai force majeure dan bagaimana perlindungan hukum bagi pekerja yang di-PHK karena pandemi Covid-19. Dalam penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan undang-undang (Statute Approach) dan pendekatan kasus (Case Approach). Bahan pustaka yang dipergunakan dalam penulisan ini adalah perundang-undangan, putusan pengadilan, buku, jurnal, website dan sebagainya yang berkaitan dengan Covid-19, PHK, dan force majeure. Hasil dari penelitian ini menunjukkan bahwa PHK yang dilakukan perusahaan dalam keadaan pandemi Covid-19 tidak serta merta menjadikan PHK kepada pekerja karena keadaan memaksa atau force majeure. PHK tersebut harus dapat dibuktikan oleh perusahan bahwa pandemi Covid-19 memberikan pengaruh besar bagi kelangsungan perusahaan yang mengakibatkan perusahaan harus melakukan PHK kepada pekerja. Pekerja yang mengalami PHK karena pandemi Covid-19 mendapat perlindungan hukum dalam Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja dan Peraturan Pemerintah Nomor 35 Tahun 2021 Tentang Perjanjian Waktu Tertentu, Ahli Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja. Kata Kunci: Pandemi Covid-19, Force Majeure dan Pemutusan Hubungan Kerja/At the beginning of 2020, the world, including Indonesia, was shocked by the corona virus disease 19 or Covid-19. One of the sectors affected by the Covid- 19 pandemic is the economic sector. The economic downturn caused many companies to suffer losses, so they had to lay off workers and even terminated their employment or layoffs. Layoffs carried out by companies to workers are generally due to the company's condition which continues to lose money due to the Covid-19 pandemic, but the pandemic situation cannot be used as a company to declare the Covid-19 pandemic as a force majeure situation. This research uses a normative juridical research method with a statute approach and a case approach. The library materials used in this writing are legislation, court decisions, books, journals, websites and so on. The results of this study indicate that layoffs carried out by companies during the Covid-19 pandemic do not necessarily result in layoffs for workers due to force majeure. The layoff must be proven by the company that the Covid-19 pandemic has had a major impact on the company's survival, which has resulted in the company having to lay off workers. Workers who have been laid off due to the Covid-19 pandemic receive legal protection in Law Number 11 of 2020 concerning Job Creation and Government Regulation Number 35 of 2021 concerning Work Agreements for Certain Time, Expert Power, Working Time and Rest Time, and Termination of Employment Relations.Keywords: The Covid-19 Pandemic, Force Majeure, and Termination of Employment
