Abstract

Bisnis kosmetik sekarang ini menjadi salah satu lahan yang menggiurkan bagi banyak orang. Tingginya demand akan kosmetik membuat menjamurnya penjaja kosmetik dihampir semua platform e-coomerce. Hal ini juga dipengaruhi oleh kondisi pandemi COVID-19 yang mengubah pola belanja masyarakat dari offline berubah ke online. Belanja online lebih gampang dan praktis , hal inilah yang menyebabkan percepatan peredaran produk kosmetik ilegal di Indonesia . Banyak orang yang menjual produk kosmetik tanpa memperdulikan apakah kosmetik tersebut telah memiliki izin edar atau tidak, banyak pelaku usaha tersebut tidak memperdulikan kualitas produk apakah sudah sesuai persyaratan keamanan , kualiatas dan mutu , hal ini dilakukan demi meraup keuntungan lebih dengan mengesampingkan kejujuran dan iktikad baik. Penulis akan menjabarkan tentang perlindungan hukum konsumen dan membahas tentang pertanggungjawaban hukum pelaku usaha atas beredarnya produk kosmetik ilegal. Metode penelitian dalam penelitian ini adalah metode penelitian yuridis normatif. Pendekatan yang digunakan penulis dalam penelitian ini adalah Pendekatan Kasus dan Pendekatan Perundang-undangan. Metode pengumpulan data yang dipergunakan adalah studi kepustakaan dan putusan hakim.Pada akhirnya perlindungan hukum konsumen dan pertanggungjawaban hukum pelaku usaha atas beredarnya produk kosmetik ilegal sudah diatur dalam UUPK, namun perlindungan konsumen atas beredarnya produk kosmetik ilegal belum efisien dan maksimal sehingga dibutuhkan perhatian lebih oleh pemerintah terkait. KATA KUNCI : Perlindungan Konsumen , Kosmetik , Ilegal Nowadays , the cosmetics business is one of most lucrative fields for many people , the high demand for cosmetics has led to the mushrooming of cosmetics vendors on almost all e-commerce platforms. This is also influenced by the condition of the COVID-19 pandemic which has changed people’s shopping patterns from offline to online. Online shopping is easier and more practical, this is what has accelerated the circulation of illegal cosmetics products in Indonesia, many people who sell cosmetic products regardless of whether the cosmetics have a circulation permit or not, many businesses do not care about the quality of the product whether it is in accordance with safety requirements and quality, this is done in order to reap more profit by putting aside honesty and good faith The author will describe the protection of consumer law and describe the legal liability of businesses for the circulation of illegal cosmetic products. Research methods in this research is a normative juridical research method. The approaches used by the authors in this research are Case Approaches and Statutory Approaches. The method of data collection used is the study of literature and the verdict of judges.In the end, consumer legal protection and legal liability of businesses for the circulation of illegal cosmetic products have been regulated in the UUPK, but consumer protection for the circulation of illegal cosmetic products has not been efficient and maximal so that more attention is needed by the related governments.
