Abstract

The involvement of homeworkers in the sub contract work through putting out system in supply chain in the labour intensive industry keeps growing in line with tight competition among domestic companies. The involvement of home workers during the production process through sub contract work from the company to individuals give rise to debate regarding the legal relation on the conflict between the homeworkers and the company or intermediaries, were categorized as a employment agreement or business agreement, due to law arising on the parties, and legal protection for home workers, case study in Jakarta. The research method of this research is normative juridical that is a research that emphasizes on the science of law, especially aimed to examine the rule / principle of law related to the problem of scheme of work in the practice of home work and its implication for the workers based on the laws and regulations in the field of labor, with using case study in DKI Jakarta area. Sources of data from this study used primary data from interviews with home and government workers, supported by secondary data covering primary legal materials such as legislation, and secondary legal materials such as research, journals, scholarly works, and others. Taking into account the characteristics of the home worker and his involvement in the production process in the supply chain of a company to produce a product / service by receiving remuneration in the form of wages for its work, indicating that a home worker is a worker who has a working relationship with the fulfillment of an element of the employment agreement, occupation, command and wage./Keterlibatan pekerja rumahan dalam skema pemborongan pekerjaan melalui putting out system dalam rantai pasok (supply chain) di industri padat karya semakin berkembang seiring dengan ketatnya persaingan diantara pelaku usaha. Keterlibatan pekerja rumahan dalam proses produksi melalui pemborongan pekerjaan dari perusahaan ke perorangan atau individu menimbulkan perdebatan perihal hubungan hukum atas perjanjian yang terjadi antara pekerja rumahan dengan perusahaan atau perantara, termasuk dalam kategori perjanjian kerja atau perjanjian bisnis, akibat hukum yang timbul bagi para pihak, dan perlindungan hukum bagi pekerja berdasarkan studi kasus di DKI Jakarta. Metode penelitian dari penelitian ini adalah yuridis normatif yaitu suatu penelitian yang menekankan pada ilmu hukum, terutama ditujukan untuk mengkaji kaidah/asas hukum yang berhubungan dengan masalah skema pemborongan pekerjaan dalam praktek kerja rumahan dan implikasinya bagi pekerja berdasarkan peraturan perundangundangan di bidang ketenagakerjaan, dengan menggunakan studi kasus di wilayah DKI Jakarta. Sumber data dari penelitian ini menggunakan data primer dari hasil wawancara dengan pekerja rumahan dan Pemerintah, ditunjang dengan data sekunder meliputi bahan hukum primer seperti peraturan perundang-undangan, dan bahan hukum sekunder seperti penelitian, jurnal, hasil karya ilmiah para sarjana, dan lainnya. Memperhatikan karakterisitik pekerja rumahan dan keterlibatannya dalam proses produksi pada rantai pasokan perusahaan untuk menghasilkan suatu produk barang/jasa dengan menerima imbalan dalam bentuk upah atas hasil kerjanya, mengindikasikan pekerja rumahan merupakan pekerja yang memiliki hubungan kerja dengan terpenuhinya unsur perjanjian kerja, pekerjaan, perintah, dan upah.
