Abstract

Pesatnya perkembangan sektor otomotif kerap menghadirkan risiko tersendiri bagi konsumen, terutama berkaitan dengan cacat tersembunyi yang sukar dikenali secara visual ketika transaksi berlangsung. Studi ini berangkat dari persoalan hukum dalam Putusan Mahkamah Agung Nomor 80 K/Pdt/2025, di mana pengadilan menolak gugatan konsumen terkait dugaan cacat produksi pada komponen kemudi. Fokus utama kajian ini adalah menganalisis penerapan prinsip keamanan dan keselamatan konsumen dalam pertimbangan hakim. Penelitian ini merupakan penelitian hukum yuridis normatif melalui pendekatan perundang-undangan dan pendekatan kasus, penulis mengkaji regulasi dan penalaran hakim. Sumber data berasal dari data sekunder (bahan hukum primer, sekunder, tersier) yang dihimpun lewat studi kepustakaan dan dianalisis secara kualitatif. Temuan penelitian menunjukkan bahwa asas keamanan konsumen belum diterapkan secara optimal dalam Putusan Nomor 80 K/Pdt/2025. Majelis hakim menolak gugatan dengan terlalu bergantung pada bukti formalitas seperti Sertifikat Registrasi Uji Tipe serta hasil uji jalan yang cenderung subjektif. Akibatnya, putusan ini dipandang hanya memenuhi standar keamanan administratif semata, belum mencapai standar keamanan substansial yang menjamin ketiadaan potensi bahaya teknis pada produk./ The rapid development of the automotive sector often presents specific vulnerabilities for consumers, particularly regarding hidden defects that are difficult to detect visually during a transaction. This study stems from legal issues in Supreme Court Decision Number 80 K/Pdt/2025, where the court rejected a consumer's lawsuit regarding alleged manufacturing defects in steering components. The primary focus of this study is to analyze the application of consumer security and safety principles within the judge's considerations. Methodologically, this research employs a normative juridical type with a descriptive-analytical specification. Through statute and case approaches, the author examines regulations and judicial reasoning. The data source is secondary data comprising primary, secondary, and tertiary legal materials collected through library research and analyzed qualitatively. The findings indicate that the principle of consumer safety has not been optimally applied in Decision Number 80 K/Pdt/2025. The panel of judges tended to reject the lawsuit by relying heavily on formal administrative evidence, such as the Type Test Registration Certificate, and subjective test drive results. Consequently, this decision is viewed as fulfilling only minimal administrative safety standards, rather than substantial safety standards that guarantee the product is free from potential technical hazards.
