Abstract
Perkembangan Financial Technology (fintech) telah mendorong transformasi Perkembangan Financial Technology (fintech) telah mendorong transformasi sistem keuangan digital di Indonesia sekaligus menghadirkan tantangan dalam mewujudkan tata kelola yang transparan, akuntabel, dan berintegritas sebagai upaya pencegahan tindak pidana korupsi. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai financial technology dalam mendukung transparansi transaksi digital serta menganalisis peran fintech dalam memperkuat penerapan prinsip Good Corporate Governance melalui transparansi transaksi digital berdasarkan perspektif hukum dan keterpaduan pengaturan perundang-undangan di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum diperoleh melalui studi kepustakaan yang dianalisis secara kualitatif menggunakan Teori Kepastian Hukum Hans Kelsen, Teori Sistem Hukum Lawrence M. Friedman, serta konsep Good Corporate Governance. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki kerangka hukum yang relatif komprehensif melalui Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan, Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik, Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, serta berbagai peraturan Bank Indonesia dan Otoritas Jasa Keuangan. Pemanfaatan fintech mampu memperkuat penerapan prinsip transparansi, akuntabilitas, responsibilitas, independensi, dan kewajaran melalui pencatatan transaksi digital yang menghasilkan digital audit trail, sehingga meningkatkan efektivitas pengawasan dan mempersempit peluang terjadinya penyalahgunaan kewenangan. Efektivitas tersebut memerlukan keterpaduan regulasi, sinergi antarotoritas, serta peningkatan budaya hukum masyarakat agar fintech dapat berfungsi secara optimal sebagai instrumen pencegahan tindak pidana korupsi. Kata Kunci: Financial Technology, Good Corporate Governance, Transparansi Transaksi Digital, Pencegahan Korupsi, Sistem Hukum. / The development of Financial Technology (fintech) has accelerated the transformation of Indonesia's digital financial system while creating challenges in establishing transparent, accountable, and integrity-based governance as an effort to prevent corruption. This study aims to analyze the legal framework governing financial technology in supporting digital transaction transparency and to examine the role of fintech in strengthening the implementation of Good Corporate Governance through digital transaction transparency from a legal perspective and the integration of Indonesian laws and regulations. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials were collected through library research and analyzed qualitatively using Hans Kelsen's Theory of Legal Certainty, Lawrence M. Friedman's Legal System Theory, and the concept of Good Corporate Governance. The findings indicate that Indonesia has established a relatively comprehensive legal framework through Law Number 4 of 2023 on Financial Sector Development and Strengthening, Law Number 1 of 2024 concerning Electronic Information and Transactions, Law Number 27 of 2022 concerning Personal Data Protection, as well as various regulations issued by Bank Indonesia and the Financial Services Authority. The implementation of fintech strengthens the principles of transparency, accountability, responsibility, independence, and fairness through digital transaction records that generate a digital audit trail, thereby improving supervisory effectiveness and reducing opportunities for abuse of authority. However, its effectiveness depends on regulatory harmonization, institutional coordination, and the development of legal awareness to optimize fintech as a preventive instrument against corruption.
