Abstract

Abstrak Indonesia Tindak pidana penganiayaan yang mengakibatkan kematian merupakan kejahatan serius karena berakibat langsung pada hilangnya nyawa seseorang serta mencederai nilai keadilan dan hak asasi manusia. Permasalahan hukum yang sering muncul dalam perkara penganiayaan adalah penilaian terhadap unsur kesengajaan (opzet), khususnya ketika pelaku tidak secara langsung bermaksud menghilangkan nyawa korban, namun menyadari kemungkinan timbulnya akibat fatal dari perbuatannya. Hal tersebut tercermin dalam perkara Gregorius Ronald Tannur, yang melibatkan rangkaian perbuatan kekerasan terhadap korban Dini Sera Afrianti hingga berujung pada kematian korban. Pada tingkat Pengadilan Negeri Surabaya, terdakwa dinyatakan bebas dari seluruh dakwaan, baik dakwaan pembunuhan maupun penganiayaan yang mengakibatkan kematian. Putusan bebas tersebut menimbulkan perdebatan hukum karena dinilai tidak sejalan dengan fakta-fakta hukum yang terungkap di persidangan dan menimbulkan pertanyaan mengenai konsistensi penerapan hukum pidana Kata Kunci: Penganiayaan, Pertanggungjawaban Pidana Abstract Inggris The criminal act of assault resulting in death constitutes a serious crime because it directly causes the loss of human life and violates the values of justice and human rights. Legal issues that frequently arise in assault cases concern the assessment of the element of intent (opzet), particularly in situations where the perpetrator does not directly intend to take the victim’s life but is aware of the possibility that fatal consequences may result from his actions. This issue is reflected in the case of Gregorius Ronald Tannur, which involved a series of acts of violence against the victim, Dini Sera Afrianti, ultimately resulting in the victim’s death. At the level of the Surabaya District Court, the defendant was acquitted of all charges, both murder and assault resulting in death.
