Abstract

This research is motivated by the major transformation of Indonesia’s constitutional and governance system after the 1998 Reformasi, particularly the abolition of the State Policy Guidelines (GBHN) and their replacement by the National Development Planning System (Sistem Perencanaan Pembangunan Nasional/SPPN) through Law No. 25 of 2004. Alongside strengthened regional autonomy, this shift positioned the Regional Long-Term Development Plan (Rencana Pembangunan Jangka Panjang Daerah/RPJPD) as a strategic legal instrument intended to ensure the continuity and consistency of regional development over a 20-year horizon. In practice, however, the consistency of the RPJPD is increasingly challenged by contemporary variables, namely the dynamics of simultaneous local elections (Pilkada Serentak) and fiscal consolidation pressures, including budget efficiency policies under Presidential Instruction No. 1 of 2025. These factors may disrupt the coherence of derivative planning documents (RPJMD/RKPD) and generate normative disharmony within the framework of a rule-of-law state. The literature review is grounded in Hans Kelsen’s hierarchy of norms (Stufenbau Theory) to examine the validity and tiered relationships of planning norms (RPJPN–RPJPD–RPJMD–RKPD) within Indonesia’s legal system, and Gustav Radbruch’s triadic legal values to assess how political and fiscal interventions affect legal certainty, utility, and justice in regional development planning. The study employs normative legal research methods using statutory, conceptual, historical, and case approaches, supported by document analysis of relevant legislation on SPPN, regional governance, elections, and regional planning instruments. Data are analyzed qualitatively through systematic-normative and thematic analysis to determine the legal status of the RPJPD and the legal implications when regional development planning is not derived from the RPJPD. The discussion indicates that, while the RPJPD formally holds binding force as a regional regulation whose validity is derived from higher norms, its functional authority is vulnerable to erosion due to misaligned political cycles and fiscal policy pressures potentially weakening planning-related legal certainty, reducing the utility of sustainable development efforts, and producing injustice in the distribution of development benefits at the regional level.
