Abstract

Indonesia merupakan negara yang terikat dalam konvensi internasional United Nations Framework Convention on Climate Change UNFCCC yang berfokus terhadap aksi-aksi mitigasi dan adaptasi terhadap perubahan iklim. Hal ini membuat Indonesia memiliki standarisasi dan kewajiban untuk mematuhi peraturan yang tertera dalam konvensi ini. Rumusan masalah pada skripsi ini adalah bagaimana pengaturan hukum Carbon Capture and Storage (CCS) di Indonesia dengan kerangka carbon governance yang ditetapkan oleh UNFCCC dan apakah Peraturan Presiden Nomor 14 Tahun 2024 tentang Penyelenggaraan Kegiatan Penangkapan dan Penyimpanan Karbon efektif dalam melakukan mitigasi perubahan lingkungan di Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perbandingan atau (comparative approach). Data yang digunakan adalah data sekunder berupa bahan hukum primer: Peraturan Presiden Nomor 14 Tahun 2024 tentang Penyelenggaraan Kegiatan Penangkapan Dan Penyimpanan Karbon, putusan COP, Perjanjian Paris, serta bahan hukum sekunder diambil melalui buku-buku juga liteartur lain, bahan hukum tertier berupa kamus, yang kemudian dianalisis lalu disusun. Dari hasil penelitian ini dapat disimpulkan bahwa Indonesia melalui Peraturan Presiden Nomor 14 Tahun 2024 telah menaati Prinsip carbon governance sepenuhnya dan telah efektif menjadi peraturan yang mengatur terkait teknologi mitigasi iklim. Namun peraturan ini perlu diintegritaskan lagi mengikuti perkembangan internasional. / Indonesia is a country bounds to the international convention of the United Nations Framework Convention on Climate Change (UNFCCC) that focuses towards climate change mitigation and adaptation actions. This made Indonesia has to have a certain standardization and obligation to comply to the convention. The problem formulations are how legal principles of Carbon Capture and Storage (CCS) in Indonesia align with the carbon governance framework established by the UNFCCC, and is Presidential Regulation No. 14 of 2024 concerning the Implementation of Carbon Capture and Storage Activities effective in mitigating climate change in Indonesia. This research is a normative legal study with a comparative approach. The data used is secondary data in the form of primary legal materials: Presendential Regulation Number 14 of 2024, Paris Agreement, as well as secondary legal materials obtained from books and other literature, Tertiary legal materials in the form of dictionaries, which are then analyzed and compiled. By this research concludes that Indonesia, through Presidential Regulation No. 14 of 2024 has comply to the Carbon Governance fully and has effectively regulates a climate mitigation technology. However, this regulation still needs need to be reintegrated in line with international developments.
