Abstract

Penelitian ini membahas tentang perlindungan hukum yang diberikan kepada jurnalis saat melakukan peliputan berita, terutama ketika berita tersebut dianggap sebagai pencemaran nama baik dan diposting di media sosial. Penelitian ini menggunakan putusan Pengadilan Negeri Palopo dengan nomor 46/Pid.Sus/2021/PN Plp sebagai bahan studi. Penelitian ini bertujuan sejauh mana Undang-Undang Pers sesuai dengan ketentuan pidana dalam KUHP dan Undang-Undang Informasi dan Transaksi Elektronik, serta dampaknya terhadap kebebasan pers. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan berupa peraturan perundang-undangan, pemikiran konseptual, dan analisis studi kasus. Penelitian menunjukkan bahwa meskipun berita yang dipermasalahkan merupakan hasil kerja jurnalistik, pemerintah tetap menerapkan aturan hukuman tanpa menggunakan mekanisme penyelesaian melalui Dewan Pers. Analisis kesimpulan menunjukkan adanya kelemahan hukum yang berdampak pada perlindungan hukum bagi wartawan yang tidak berjalan optimal. Penelitian ini menyatakan bahwa peran Dewan Pers perlu diperkuat serta aturan-aturan hukum harus diharmoniskan agar dapat mencapai keadilan yang sebenarnya, kepastian hukum, serta perlindungan hak kebebasan pers./ This study examines the legal protection afforded to journalists when reporting news, particularly when the news is deemed defamatory and posted on social media. The study uses the Palopo District Court's decision number 46/Pid.Sus/2021/PN Plp as the basis. This study aims to determine the extent to which the Press Law complies with the criminal provisions of the Criminal Code and the Electronic Information and Transactions Law, and its impact on press freedom. The research method used is normative legal research, utilizing statutory regulations, conceptual thinking, and case study analysis. The study shows that even though the news in question is the result of journalistic work, the government continues to apply punitive provisions without utilizing the resolution mechanism through the Press Council. The analysis concludes with legal weaknesses that impact the suboptimal legal protection for journalists. This study argues that the role of the Press Council needs to be strengthened and legal regulations must be harmonized to achieve true justice, legal certainty, and protection of the right to press freedom.
