Abstract

Praktik monopoli sering sekali dilakukan oleh pelaku usaha yang mereknya sudah terkenal dan sudah memiliki posisi dalam suatu pasar tertentu dengan berbagai alasan, salah satunya menghalangi pelaku usaha lain masuk ke dalam pasar tersebut supaya tidak memiliki saingan. Praktik monopoli harus dihindari supaya persaingan antar pelaku usaha menjadi sehat. Dalam penelitian ini permasalahan yang dibahas adalah bentuk-bentuk praktik monopoli yang dilarang dilakukan oleh pelaku usaha, serta penguasaan pasar yang dilakukan dengan jujur dan penguasaan pasar dengan melakukan praktik monopoli. Penelitian ini menggunakan metode hukum normatif dengan pendekatan kasus, dengan menggunakan bahan hukum primer, Putusan KPPU Nomor 14/KPPU-L/2015, Kitab Undang-Undang Hukum Perdata (KUHPerdata), Undang-Undang Antimonopoli, serta bahan hukum sekunder dari buku dan jurnal, dan bahan hukum tersier seperti Kamus Besar Bahasa Indonesia. Hasil penelitian menunjukan bahwa praktik monopoli memiliki beberapa bentuk, seperti kegiatan yang dilarang, perjanjian yang dilarang, dan penyalahgunaan posisi dominan. Dalam perumusannya setiap bentuk dari praktik monopoli memiliki pendekatan tiap rumusan pasal tersebut, yang dimana dirumuskan dengan pendekatan rule of reason maupun per se illegal. Selain itu, setiap pelaku usaha yang mereknya sudah terkenal atau menguasai posisi dalam suatu pasar belum tentu melakukan praktik monopoli, bisa saja dikarenakan keberhasilan dari strategi pemasaran yang digunakan, akan tetapi pelaku usaha yang melakukan praktik monopoli sudah pasti akan membuat persaingan menjadi tidak sehat. / Monopolistic practices are frequently conducted by business entities whose brands are already well-established and possess a significant position within a particular market, often with the intention of preventing other enterprises from entering that market and thereby avoiding competition. Such practices must be curtailed in order to promote fair and healthy competition among market participants. This study examines the forms of monopolistic practices prohibited under the law, as well as the legitimate market dominance and dominance achieved through monopolistic conduct. The research adopts a normative legal methodology with a case approach, drawing upon primary legal sources such as KPPU Decision No. 14/KPPU-L/2015, the Indonesian Civil Code (KUHPerdata), and the Anti-Monopoly Law. It also utilizes secondary legal sources, including scholarly books and journals, as well as tertiary legal sources such as the Kamus Besar Bahasa Indonesia. The findings of this study indicate that monopolistic practices manifest in several forms, including prohibited activities, unlawful agreements, and abuse of dominant market position. Each form is regulated through distinct legal formulations, which are approached either under the rule of reason or the per se illegal. Moreover, not all enterprises with strong brand recognition or dominant market positions are necessarily engaged in monopolistic behavior; such positions may also result from effective marketing strategies. However, it is evident that any business entity engaging in monopolistic practices inevitably undermines the principles of fair competition.
