Abstract

Negara Indonesia merupakan negara hukum, masyarakat saat ini sangat membutuhkan adanya suatu penegakan hukum yang mengakomodir kepentingan dan menyelesaikan permasalahan secara adil serta menampung aspirasi kehendak dari masyarakat itu sendiri terutama kepentingan pemulihan korban yang selama menjadi pihak yang dirugikan dan tidak mendapatkan perhatian. Munculnya sebuah konsep Restorative Justice merupakan sebuah hasil pemikiran yang merespon pengembangan sistem peradilan pidana dengan menitik beratkan pada kebutuhan pelibatan masyarakat dan korban yang dirasa tersisihkan dengan mekanisme yang bekerja pada sistem peradilan pidana yang ada saat ini. Dengan adanya keadilan Restorative Justice ini adalah sebuah proses dimana para pihak yang berkepentingan dalam pelanggaran tertentu bertemu bersama untuk menyelesaikan persoalan secara bersama-sama bagaimana menyelesaikan akibat dari pelanggaran tersebut demi kepentingan masa depan. Restorative Justice juga sebagai suatu sistem hukum yang bertujuan untuk mengembalikan kesejahteraan korban, pelaku dan masyarakat yang rusak oleh kejahatan, dan untuk mencegahkan pelanggaran atau tindakan kejahatan lebih lanjut dengan menitikberatkan pada pemulihan dan menghindari pembalasan serta mempertimbangkan aspirasi korban dan tanggungjawab pelaku. Penelitian ini menggunakan metode penelitian yuridis normatif, yang bertitik tolak pada norma-norma dan hukum positif serta peraturan pelaksanaan lainnya, peneliti menganalisis Laporan Hasil Pelaksanaan Gelar Perkara Penghentian Penyidikan Dugaan Tindak Pidana Penipuan dan/atau Penggelapan Laporan Polisi Nomor: LP/B/0664/XI/2021/BARESKRIM POLRI, tanggal 1 November 2021, atas nama pelapor HADI IRWANTO. Penyelesaian kasus penipuan dan penggelapan secara Restorative Justice dilakukan agar meminimalisir masalah antara pihak pelaku dan pihak keluarga serta agar bisa memaafkan si pelaku. Karena seringkali apabila diselesaikan dengan cara dijatuhi hukuman belum menyelesaikan semua konflik yang ada. Penanganan tindak pidana berdasarkan Restorative ini harus memenuhi syarat formil dan materil. Apabila telah terpenuhi keduanya, maka dapat dilakukan penghentian penyidikan atau penyelidikan dengan menggunakan gelar perkara khusus. Kata Kunci: Penipuan, penggelapan, restorative justice / The Republic of Indonesia is a legal state, and society today greatly needs a law enforcement that accommodates interests and resolves issues fairly while capturing the aspirations of the community itself, especially the interests of victim recovery who have been the disadvantaged party and have not received attention. The emergence of a concept of Restorative Justice is a result of thinking that responds to the development of the criminal justice system by emphasizing the need for community and victim involvement, which is felt to be marginalized by the mechanisms that operate in the current criminal justice system. With the existence of Restorative Justice, it is a process where the parties interested in a certain violation meet together to jointly resolve the issues of how to address the consequences of the violation for the sake of future interests. Restorative Justice also serves as a legal system aimed at restoring the welfare of victims, perpetrators, and the community harmed by crime, and to prevent further violations or criminal acts by emphasizing recovery and avoiding retaliation while considering the aspirations of victims and the responsibilities of perpetrators. This research uses a normative legal research method, which is based on norms and positive law as well as other implementing regulations. The researcher analyzes the Report on the Results of the Implementation of the Case Title of the Termination of Investigation of Alleged Criminal Acts of Fraud and/or Embezzlement Police Report Number: LP/B/0664/XI/2021/BARESKRIM POLRI, dated November 1, 2021, on behalf of the reporter HADI IRWANTO. The resolution of the fraud and embezzlement case through Restorative Justice is carried out to minimize problems between the perpetrator and the family and to enable forgiveness of the perpetrator. Because often, if resolved by imposing a sentence, it does not resolve all existing conflicts. Handling criminal acts based on this Restorative approach must meet formal and material requirements.
