Abstract

Berlandaskan bertumbuhnya toko modern yang membagikan dampak yang buruk bagi pasar tr adisional serta bisnis kecil. Dalam perihal ini pasar tradisional serta bisnis kecil mengalami pengurangan omset akibat bertumbuhnya toko modern. Perihal ini karena, pasar tradisional serta bisnis kecil mempunyai bermacam kelemahan yang membuat usaha mereka kalah berkompetisi dengan toko modern. Rumusan masalah dalam skripsi ini ialah apakah dampak bertumbuhnya toko modern besar bagi pelaku bisnis pasar tradisional serta bisnis kecil, serta bagaimana perlindungan hukum terhadap pasar tradisional serta bisnis kecil berlandaskan UU. No. 5 Tahun 1999 terkait Anti Monopoli Pasal 1 angka 6. Riset ini ialah riset hukum normatif dengan pendekatan perundang undangan (statute approach) serta pendekatan konseptual (conceptual approach). Data yang dipergunakan ialah data sekunder berbentuk hukum primer: Undang-Undang Nomor 5 Tahun 1999 terkait Anti Monopoli serta Perpres No. 112 Tahun 2007 terkait Penataan serta Pembinaan Pasar Tradisional, Sentral Perbelanjaan serta Toko Modern, sedangkan bahan hukum sekunder didapati dari buku-buku ataupun literatur lain, serta bahan hukum tersier berbentuk kamus, sehingga bahan hukum yang terkumpul disusun serta dianalisis. Dengan riset ini, peneliti mempergunakan teori keadilan untuk menganalisa dampak pertumbuhan toko modern terhadap pasar tradisional serta bisnis kecil serta teori perlindungan hukum terhadap pasar tradisional serta bisnis kecil akibat pertumbuhan toko modern./Base on the development of modern shops which has a negative impacts on traditional market and small businesses. In this case, traditional markets and small businesses have experience a decline in turnover due to the development of modern shops. This is because traditional markets and small businesses have various weaknesses that make their businesses unable to compete with modern shops. The formulations of the problems in these thesis is what impact the development of large modern shops will have on traditional market businesses and small businesses, and what is the legal protection for traditional markets and small businesses based on the law. No. 5 of 1999 concern Anti-Monopoly Article 1 number 6. This researched is normative legal researched with a statutory approached and a conceptually approached. The data use is secondary data in form of primally law: Law Number 5 of 1999 concern Anti-Monopoly and Presidential Decree No. 112 of 2007 concerning the Arrangements and Developments of Traditional Market, Shopping Center and Modern Store, while secondaries legal material are obtained from books and other literature, and tertiary legal material are in forms of dictionaries, so that the legal materials collected are compiled and analyzed. With this research, the author uses justice theory to analyzing the impacts of the development of moderns shops on traditional market and small business and the theory of legal protection for traditional market and small business due to the development of modern shops
