Abstract

Perkembangan teknologi memunculkan istilah affiliator yang mempromosikan produk e-commerce, sering menggunakan video dari content creator tanpa izin. Rumusan masalah dalam skripsi ini adalah bagaimana pengaturan hukum Indonesia yang dapat melindungi karya ciptaan dalam bentuk video yang diunggah di sosial media dan bagaimana perlindungan hukum Indonesia terhadap content creator yang karya cipta videonya dibajak oleh affiliator di shopee. Metode yang digunakan dalam penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan atau statute approach. Data yang digunakan adalah data sekunder berupa bahan hukum primer: Undang-Undang Hak Cipta dan Undang-Undang Informasi dan Transaksi Elektronik, sedangkan bahan hukum sekunder diperoleh dari buku-buku maupun literatur lain, bahan hukum tersier berupa kamus kemudian bahan hukum yang terkumpul disusun dan dianalisis. Dari hasil penelitian ini dapat disimpulkan bahwa dalam pengaturan yang melindungi karya cipta video telah diatur dalam Pasal 40 ayat (1) UU Hak Cipta dan Pasal 25 UU ITE. Content creator juga memerlukan perlindungan hukum yang perlindungan hukumnya dapat dalam bentuk represif dengan dilakukannya gugatan perdata yang diatur dalam Pasal 96 ayat (1) UU Hak Cipta dan gugatan pidana dalam Pasal 113 UU Hak Cipta. Selain itu, juga dapat dilakukannya perlindungan hukum bentuk preventif seperti penggunaan watermark, melakukan perjanjian kerja sama, dan memonitor konten dengan aktif. / The development of technology has given rise to the term “affiliator” which promotes e-commerce products, often using videos from content creators without permission. The formulation of the problem in this thesis is how Indonesian legal regulations can protect works in the form of videos uploaded on social media and how Indonesian legal protection applies to content creators whose video works are pirated by Shopee affiliates. The method used in this research is normative legal research with a statutory approach. The data used are secondary data in the form of primary legal materials: Copyright Law and Electronic Information and Transactions Law, while secondary legal materials are obtained from books and other literature,tertiary legal materials in the form of dictionaries, and then the collected legal materials are organized and analyzed. From the results of this research, it can be concluded that the regulation protecting video creations has been stipulated in Article 40 paragraph (1) of the Copyright Law and Article 25 of the ITE Law. Content creators also require legal protection, which can take the form of repressive measures through civil lawsuits regulated in Article 96 paragraph (1) of the Copyright Law and criminal lawsuits in Article 113 of the Copyright Law. Additionally, preventive legal protection can also be implemented, such as using watermarks, entering into cooperation agreements, and actively monitoring content.
