Abstract
Pemutusan Hubungan Kerja (PHK) merupakan awal dari pengakhiran hubungan kerja bagi pekerja karena alasan tertentu. Ketika PHK terjadi maka hak dan kewajiban antara pekerja dengan pengusaha juga berakhir. Pekerja tidak hanya kehilangan pekerjaan, tetapi kestabilan ekonomi yang berdampak pada kesejahteraan keluarga. Oleh karena itu, PHK menjadi hal yang menakutkan bagi pekerja atau serikat pekerja karena ancaman terhadap kelangsungan hidup dan kualitas hidup pekerja sangat nyata. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Data-data yang digunakan pada penelitian ini menggunakan jenis data sekunder berupa bahan hukum primer: Kitab Undang-Undang Hukum Perdata Undang-Undang Ketenagakerjaan, Undang-Undang Cipta Kerja, Putusan Peradilan Hubungan Industrial Nomor 10/Pdt.Sus-PHI/2024/PN.Jkt.Pst bahan hukum sekunder dalam penelitian ini diperoleh dari buku-buku, sedangkan bahan hukum tersier berupa kamus hukum, internet. Dari hasil penelitian dapat disimpulkan bahwa dalam pengaturan PHK yang telah diatur dalam Undang-Undang Ketenagakerjaan, Undang�Undang Cipta Kerja, Peraturan Pemerintah Nomor 35 Tahun 2021 khususnya mengenai pemutusan hubungan kerja terdapat peraturan yang jelas bahwa pemerintah, pengusaha, pekerja dan serikat pekerja harus mengupayakan supaya tidak terjadi pemutusan hubungan kerja tetapi dalam praktiknya masih banyak pemutusan hubungan kerja yang dilakukan pengusaha tidak sesuai dengan ketentuan undang-undang dan tanpa adanya penetapan pengadilan hubungan industrial. / Termination of Employment (PHK) is the beginning of the termination of employment for workers for certain reasons. When layoffs occur, the rights and obligations between workers and employers also end. Workers not only lose their jobs, but also their economic stability, which affects the welfare of their families. Therefore, layofss become a frightening thing for workers or trade unions because the threat to the survival and quality of life of workers is very real. This research is a normative legal research with a statute approach and case approach. The data used in this research uses secondary data in the form of primary legal materials: Civil Code, Omnibus Law, Industrial Relations Court Decision Number 10/Pdt.Sus-PHI/2024/PN.Jkt.Pst. secondary legal materials in this reasearch are obtained from books, while tertiary legal materials are legal dictionaries, internet. From the results of the study, it can be concluded that in the regulation of termination of employment that has been regulated in the omnibus Law, Givrment Regulations Number 35 of 2021, especially reggrading termination of employment, there are clear regulations that the government, employers, workers and trade unions must strive so that termination of employment does not occur, but in the practice there are still many terminations of employment carried out by employers not in accordance with the provisions of the law and without a determination of the industrial relations court.
