Abstract

Alih Penelitian ini bertujuan untuk mengkaji peran akselerasi teknologi informasi (TI) — seperti Legal Technology (LegalTech), Regulatory Technology (RegTech), blockchain, dan smart contract — dalam memperkuat kepatuhan etis dan transparansi sistem hukum bisnis di Indonesia. Kemajuan teknologi ini diharapkan dapat menekan praktik tidak etis seperti pungutan liar, premanisme hukum, serta korupsi yang selama ini melemahkan sistem hukum nasional. Secara normatif, penguatan dasar hukum bagi penerapan TI tercermin dalam Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua atas UU ITE, yang mempertegas validitas dokumen elektronik, serta Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP), yang menegaskan prinsip perlindungan data pribadi sebagai hak konstitusional warga negara. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Penelitian ini berupaya menelusuri keterkaitan antara norma hukum positif dan inovasi teknologi informasi dalam praktik hukum bisnis modern. Hasil penelitian menunjukkan bahwa meskipun terdapat kesenjangan regulasi (regulatory lag) dalam penerapan AI dan smart contract, peluang penerapan TI terhadap reformasi hukum sangat besar — terutama dalam mewujudkan good corporate governance, transparansi hukum, serta efisiensi administratif melalui otomatisasi regulasi (RegTech). Kata Kunci: Teknologi Informasi, Kepatuhan Etis, Hukum Bisnis / This research aims to analyze the role of accelerating information technology (IT)—such as LegalTech, RegTech, blockchain, and smart contracts—in strengthening ethical compliance and transparency within Indonesia’s business law system. These technologies are expected to suppress unethical practices such as extortion, legal thuggery, and corruption that have weakened legal integrity. Normatively, the legal foundation for IT adoption is reinforced by Law No. 1 of 2024 on the Second Amendment to the ITE Law, which affirms the validity of electronic documents, and Law No. 27 of 2022 on Personal Data Protection (PDP Law), which establishes personal data security as a constitutional right. Using a normative juridical method with statutory and conceptual approaches, this study explores the relationship between positive law norms and technological innovation in modern business legal practice. Findings indicate that despite regulatory lags regarding AI and smart contracts, IT provides a significant opportunity to strengthen good corporate governance, legal transparency, and administrative efficiency through automation technologies like RegTech Keywords: Information Technology, Ethical Compliance, Business Law
