Abstract

Saat ini tidak sedikit pengusaha yang melakukan PHK kepada pekerjanya namun tidak memberikan hak-hak yang dimiliki oleh pekerjanya. Salah satunya ialah kasus pada perkara bernomor 149/Pdt.Sus-PHI/2022/PN Jkt.Pst. Pekerja memiliki hubungan kerja berdasarkan PKWT dengan pengusaha dalam jangka waktu 12 bulan, namun pada bulan keenam pengusaha melakukan PHK dan tidak membayar hak pekerjanya. Rumusan masalah dalam skripsi ini adalah bagaimana perlindungan hukum terhadap pekerja kontrak yang mengalami PHK sepihak oleh pengusaha, dan apakah pertimbangan hukum Majelis Hakim dalam putusan PHI Nomor 149/Pdt.Sus-PHI/2022/PN Jkt.Pst Tentang PHK sepihak oleh PT. Tower Putra Indonesia kepada pekerja sudah sesuai dengan ketentuan perundang-undangan ketenagakerjaan yang berlaku. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Bahan-bahan hukum tersebut dikumpulkan kemudian disusun dan dianalisis. Hasil penelitian ini disimpulkan bahwa perlindungan hukum bagi pekerja kontrak yang mengalami PHK sepihak oleh pengusaha adalah hak atas uang ganti rugi (Pasal 62 UU Ketenagakerjaan), hak atas uang kompensasi (Pasal 61A UU Cipta Kerja 2020). Pertimbangan hukum Majelis Hakim pada perkara nomor 149/Pdt.Sus-PHI/2022/PN Jkt.Pst belum memenuhi kepastian hukum, karena hak atas uang kompensasi belum didapatkan pekerja, lantaran tidak dimasukan dalam gugatan. Kata Kunci : Perlindungan Hukum, Pemutusan Hubungan Kerja, Pekerja Kontrak / Currently, there are quite a few employers who lay off their workers but do not provide the rights that their workers have. One of the cases is in case number 149/Pdt.Sus-PHI/2022/PN Jkt.Pst. The worker has an employment relationship based on PKWT with the employer for a period of 12 months, but in the sixth month the employer laid off the worker and did not pay the worker's rights. The formulation of the problem in this thesis is how is the legal protection for contract workers who experience unilateral layoffs by the employer, and whether the legal considerations of the Panel of Judges in the PHI decision Number 149/Pdt.Sus-PHI/2022/PN Jkt.Pst Concerning unilateral layoffs by PT. Tower Putra Indonesia to workers is in accordance with the provisions of applicable labor laws and regulations.This research is a normative legal research with a statutory approach and a case approach. The data used are secondary data consisting of primary, secondary and tertiary legal materials. These legal materials are collected, then compiled and analyzed. The results of this study concluded that legal protection for contract workers who experience unilateral layoffs by employers is the right to compensation (Article 62 of the Manpower Law), the right to compensation (Article 61A of the 2020 Job Creation Law). The legal considerations of the Panel of Judges in case number 149/Pdt.Sus-PHI/2022/PN Jkt.Pst have not fulfilled legal certainty, because the right to compensation has not been obtained by workers, because it was not included in the lawsuit.
