Abstract

Keberagaman produk yang beredar di internet membuat minat konsumen akan meningkat tiap tahunya. Hal tersebut merupakan peluang bagi pelaku usaha untuk memproduksi dan memperjual belikan produk-produk yang mempunyai batasan waktu tertentu hingga tidak boleh digunakan baik secara hukum atau karena melampaui masa simpan yang diantisipasi untuk barang- barang yang mudah rusak. Penelitian ini membahas tentang produk yang tanggal kadaluarsanya sudah melewati batas yang sering ditemui dan membuat resah masyarakat. Permasalahan yang diangkat didalam penelitian ini yakni bagaimana tanggung jawab pelaku usaha terhadap produk kadaluwarsa tersebut dan bagaimana upaya hukum yang dilakukan konsumen. Metode penulisan dari penelitian ini menggunakan jenis penelitian hukum normatif dan menggunakan pendekatan perUndang-undangan yakni Undang-undang No. 8 tahun 1999 Tentang Perlindungan konsumen. Perlindungan hukum bagi konsumen yang menerima produk kadaluarsa tercantum didalam Undang- undang No. 8 tahun 1999 yang meliputi hak-hak konsumen dan kewajiban.=The diversity of products circulating on the internet means that consumer interest will increase every year. This is an opportunity for business actors to produce and sell products that have a certain time limit so that they cannot be used either legally or because they exceed the anticipated shelf life for perishable goods. This research discusses products whose expiry date has passed the limit which is often encountered and makes people anxious. The problem raised in this research is how business actors are responsible for expired products and what legal measures are taken by consumers. The writing method for this research uses a normative legal research type and uses a statutory approach, namely Law no. 8 of 1999 concerning consumer protection. Legal protection for consumers who receive expired products is contained in Law no. 8 of 1999 which covers consumer rights and obligations.
