Abstract
ABSTRAK Judul : Kepastian Hukum Terhadap Keamanan Investasi Bagi Pelaku Bisnis Pelayaran Di Perairan Indonesia Perairan Indonesia memiliki potensi besar sebagai sumber daya ekonomi yang dapat dimanfaatkan untuk mengembangkan bisnis pelayaran. Dalam konteks operasional di perairan Indonesia, keselamatan pelayaran menjadi isu utama. Meskipun regulasi pelayaran di Indonesia sudah cukup memadai dengan adanya Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran dan Undang-Undang Nomor 32 Tahun 2014 tentang Kelautan, pelaku bisnis sewa kapal sering menghadapi tantangan dalam penerapannya. Teori yang digunakan dalam penelitian ini adalah teori negara hukum dan teori kepastian hukum untuk menganalisis regulasi keamanan investasi bagi pelaku usaha bisnis sewa kapal. Spesifikasi penelitian yang digunakan oleh penulis adalah metode yuridis normatif dengan metode pendekatan analitis (analytical approach) dan pendekatan perundang-undangan (statue approach). Jenis data yang dipergunakan dalam penelitian ini adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang dikumpulkan melalui teknik kepustakaan. Dalam penelitian ini, penulis menggunakan pendekatan deskriptif dalam analisis data. Hasil penelitian menujukkan bahwa aturan hukum bagi pelaku bisnis pelayaran di perairan Indonesia yang diatur dalam Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran dan Undang-Undang Nomor 32 Tahun 2014 tentang Kelautan, tidak hanya menjadi kerangka kerja bisnis tetapi juga melindungi semua pihak terkait, memastikan keselamatan, kelancaran, dan pengelolaan sumber daya laut secara efektif untuk mendukung pertumbuhan ekonomi dan menjaga kedaulatan wilayah. Selain itu, implementasi aturan hukum yang berlaku bagi pelaku bisnis pelayaran di perairan Indonesia berkaitan dengan kepastian hukum adalah menciptakan lingkungan yang kondusif bagi para pelaku usaha. Undang- Undang Nomor 17 Tahun 2008 tentang Pelayaran mengatur secara rinci keselamatan pelayaran, termasuk syarat teknis kapal, kelaiklautan, prosedur navigasi, dan perlindungan awak kapal. Pasal 124 ayat (2) undang-undang tersebut memberikan kepastian hukum terkait standar keselamatan bagi pelaku usaha sewa kapal untuk meminimalisir risiko kecelakaan. Salah satu instrumen kunci dari keselamatan pelayaran adalah peran Kesyahbandaran dalam menerbitkan Surat Ijin Berlayar (SIB) atau Surat Persetujuan Berlayar (SPB). Pelaku bisnis sering menghadapi tantangan seperti inkonsistensi hukum, birokrasi yang rumit, dan korupsi, yang menghambat kepastian dan efisiensi operasional. Kata Kunci: Kepastian Hukum, Keamanan Investasi, Bisnis Sewa Kapal / ABSTRACT Title : The Legal Certainty of Investment Security For Shipping Business Operators In Indonesian Waters Indonesian waters possess significant potential as an economic resource that can be utilized to develop the shipping industry. In the context of operations within Indonesian waters, maritime safety is a primary concern. Although maritime regulations in Indonesia are adequate with the enactment of Law No. 17 of 2008 on Shipping and Law No. 32 of 2014 on Marine Affairs, shipping business operators often face challenges in their implementation. The theories used in this research are the theory of the rule of law and the theory of legal certainty to analyze investment security regulations for charter ship business operators. The research specification applied is the normative juridical method with an analytical approach and a statute approach. The data used in this research is secondary data, consisting of primary legal materials, secondary legal materials, and tertiary legal materials collected through literature study techniques. The research employs a descriptive approach in data analysis. The results show that the legal regulations for shipping business operators in Indonesian waters, as stipulated in Law No. 17 of 2008 on Shipping and Law No. 32 of 2014 on Marine Affairs, not only serve as a business framework but also protect all related parties, ensuring safety, smooth operations, and effective management of marine resources to support economic growth and safeguard territorial sovereignty. Furthermore, the implementation of legal regulations for shipping business operators in Indonesian waters regarding legal certainty aims to create a conducive environment for business operators. Law No. 17 of 2008 on Shipping elaborates in detail on maritime safety, including technical ship requirements, seaworthiness, navigation procedures, and crew protection. Article 124 (2) of this law provides legal certainty regarding safety standards for charter ship operators to minimize accident risks. One of the key instruments of maritime safety is the role of the Port Authority in issuing Sailing Permits (SIB) or Sailing Approval Letters (SPB). Business operators often face challenges such as legal inconsistencies, bureaucratic complexities, and corruption, which hinder certainty and operational efficiency.
