Abstract

Penelitian ini membahas implementasi hubungan hukum pekerja pada perusahan outsourcing dan ketentuan pemutusan hubungan kerja pasca berlakuknya undang-undang nomor 6 tahun 2023 tentang cipta kerja. Penelitian ini bertujuan untuk memberikan manfaat bagi peneliti dan masyarakat dalam memberikan pemahaman secara teori hukum serta pelaksanaan Implementasi Hubungan Hukum Pekerja pada Perusahaan Outsourcing Pasca Berlakunya UU Nomor 6 Tahun 2023, dan untuk mengetahui dan menganalisis Implentasi Hubungan Hukum Pekerja pada Perusahaan Outsourcing, serta untuk mengetahui dan menganalisis pemutusan hubungan kerja terhadap Pekerja pada Perusahaan Outsourcing pasca berlakuknya Undang-Undang Nomor 6 Tahun 2023 dibandingkan dengan putusan Nomor 524 K/Pdt.Sus-Phi/2022. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Pendekatan dalam penelitian ini yang penulis akan gunakan adalah pendekatan undang-undang, dan jenis serta sumber datanya adalah menggunakan jenis data sekunder. Hasil penelitian ini dapat disimpulkan bahwa Implementasi hubungan hukum pekerja pada perusahaan outsourcing pasca berlakunya UU Nomor 6 Tahun 2023 belum sepenuhnya memberikan rasa kepastian hukum, keadilan dan kemanfaatan. Hal tersebut dikarenakan adanya ketidakpastian hukum atas UU Nomor 6 Tahun 2023. Pemutusan hubungan kerja terhadap pekerja pada perusahaan outsourcing pasca berlakunya UU Nomor 6 Tahun 2023 jika dibandingkan dengan putusan Pengadilan Nomor 524 K/Pdt.Sus-PHI/2022 maka dinilai belum memberikan rasa keadilan dan kelayakan./ This research discusses the implementation of the legal relationship of workers in outsourcing companies and the regulations on termination of employment following the enactment of Law Number 6 of 2023 on Job Creation. The purpose of this research is to provide benefits for researchers and the community in understanding the theoretical aspects of law as well as the implementation of the legal relationship of workers in outsourcing companies after the enactment of Law Number 6 of 2023. It aims to identify and analyze the implementation of the legal relationship of workers in outsourcing companies, as well as to examine and analyze the termination of employment for workers in outsourcing companies following the enactment of Law Number 6 of 2023 compared to Decision Number 524 K/Pdt.Sus-Phi/2022. The type of research used in this study is normative legal research. The approach taken in this study is a statutory approach, and the type and source of data used are secondary data. The results of this research conclude that the implementation of the legal relationship of workers in outsourcing companies post the enactment of Law Number 6 of 2023 has not fully provided a sense of legal certainty, justice, and benefit. This is due to the legal uncertainty surrounding Law Number 6 of 2023. The termination of employment for workers in outsourcing companies after the enactment of Law Number 6 of 2023, when compared to the ruling of the Court Number 524 K/Pdt.Sus-PHI/2022, is deemed to have not provided a sense of justice and appropriateness.
