Abstract
ABSTRAK Judul Tesis: ANALISIS YURUDIS TERHADAP PENERAPAN EKSEPSI DALAM PERSIDANGAN PERKARA PERDATA DI INDONESIA. Kata Kunci: Eksepsi dalam persidangan perkara perdata, Pasal 136 HIR/Pasal 162 RBg, peradilan sederhana, cepat dan biaya ringan. Penelitian ini mengkaji penerapan eksepsi dalam praktik peradilan perkara perdata di Indonesia, bagaimana pengaturannya dan penerapannya apakah sesuai prinsip hukum yaitu peradilan dilakukan dengan sederhana, cepat dan biaya ringan dan apakah mewujudkan keadilan, kepastian dan kemanfaatan hukum bagi pihak yang bersengketa. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan terdapat perbedaan pandangan di antara hakim dalam memutus penerapan eksepsi sebagaimana diatur dalam Pasal 136 HIR/Pasal 162 RBg. Perbedaan pandangan ini bertentangan dengan asas peradilan dilakukan dengan sederhana, cepat, dan biaya ringan dan pada akhirnya tidak mewujudkan tujuan hukum. Untuk optimalnya penerapan eksepsi dan untuk menghindari perbedaan pandangan di antara hakim dalam penerapan eksepsi di dalam suatu persidangan perkara perdata, Mahkamah Agung perlu menerbitkan Peraturan Mahkamah Agung (PERMA) atau Surat Edaran Mahkamah Agung (SEMA) sebagai pedoman bagi para pihak yang berperkara, terutama bagi hakim dalam memeriksa dan mengadili suatu perkara perdata. Selain itu, proses unifikasi hukum acara perdata melalui pembentukan Undang-Undang tentang Hukum Acara Perdata perlu dipercepat agar terdapat peraturan yang jelas dan seragam mengenai hukum acara perdata di Indonesia. / ABSTRACT Title Tesis: LEGAL ANALYSIS OF THE APPLICATION OF EXCEPTION IN CIVIL TRIALS IN INDONESIA. Keywords: Exception" in Civil Case Proceedings, Article 136 HIR/Article 162 RBg, simple, fast, and low-cost justice. This research examines the application of exceptions (or "objections") in civil judicial practice in Indonesia, focusing on their regulation and whether their implementation aligns with the legal principles of simplicity, speed, and low cost. It also investigates whether the application of these exceptions achieves the legal objectives of providing justice, legal certainty, and utility for disputing parties. The study employs a normative legal research method with a statutory approach and a case approach. The findings reveal differing views among judges in ruling on the application of exceptions, as stipulated in Article 136 of the Herzien Inlandsch Reglement (HIR) and Article 162 of the Reglement op de Burgerlijke Rechtsvordering (RBg). These divergent views contradict the principles of simple, speedy, and low-cost justice and fail to achieve the objectives of law. To optimize the application of exceptions and prevent differing judicial interpretations in civil court proceedings, the Supreme Court could issue a Supreme Court Regulation (PERMA) or a Supreme Court Circular Letter (SEMA). These would serve as guidelines for litigants, especially judges, when addressing exceptions in civil trials. Additionally, the process of unifying civil procedural law through the enactment of a new Civil Procedure Law needs to be expedited to establish clear and uniform regulations concerning civil procedure in Indonesia.
