Abstract

Dalam pelaksanaan penegakan hukum terhadap kasus pencemaran nama baik di media sosial, terdapat ketidaksesuaian antara norma hukum yang berlaku dengan praktik yang terjadi dalam proses peradilan dan penjatuhan putusan. Seperti pada Putusan Nomor 202/Pid.Sus/2023/PN.JktTim melibatkan aktivis yang menyuarakan situasi hak asasi manusia dan lingkungan hidup di Papua. Kasus ini diproses hingga persidangan pokok, meskipun seharusnya dapat dihentikan melalui putusan sela sesuai ketentuan Surat Keputusan Ketua Mahkamah Agung No. 36/KMA/SK/11/2013. Rumusan masalah dalam penelitian ini adalah Bagaimana perlindungan hukum terhadap aktivis terkait dengan pencemaran nama baik di media sosial dan Bagaimana pertimbangan hukum putusan dalam menjatuhkan Putusan Nomor 202/Pid.Sus/2023/PN.JktTim terhadap aktivis. Metode penelitian yang digunakan adalah yuridis normatif, yaitu penelitian yang mengacu pada data sekunder melalui studi kepustakaan. Dari hasil penelitian dapat disimpulkan bahwa Putusan Pengadilan Negeri Jakarta Timur Nomor 202/Pid.Sus/2023/PN Jkt.Tim tidak mengacu pada Surat Keputusan Ketua Mahkamah Agung No. 36/KMA/SK/11/2013, meskipun tindakan terdakwa berkaitan dengan kepentingan publik di bidang lingkungan hidup. / In the enforcement of law regarding defamation cases on social media, there is a discrepancy between the applicable legal norms and the practices observed in judicial proceedings and verdict pronouncements. As in the Ruling of the Rantau Prapat District Court Number 202/Pid.Sus/2023/PN.JktTim involves two activists. The case proceeded to the main trial, even though it should have been dismissed through an interlocutory decision in accordance with the provisions of Chief Justice of the Supreme Court of the Republic of Indonesia Number 36/KMA/SK/11/2013. The research problems in this study are: How is legal protection provided to activists in defamation cases on social media and What are the legal considerations of the judges in issuing Decision Number 202/Pid.Sus/2023/PN.JktTim against the activists. The research method employed is normative juridical, which refers to secondary data obtained through library research. Based on the research findings, it can be concluded that the East Jakarta District Court Decision Number 202/Pid.Sus/2023/PN Jkt.Tim did not refer to Chief Justice of the Supreme Court of the Republic of Indonesia Number 36/KMA/SK/11/2013, despite the fact that the defendant actions were related to public interest in environmental issues.
