Abstract

Penelitian ini membahas perlindungan hukum terhadap anak di bawah umur yang diperdagangkan di Indonesia, dengan studi kasus pada putusan Pengadilan Tinggi Manado No. 10/PID/2021/TN MND. Hak asasi anak merupakan aspek yang tidak dapat dipisahkan dalam diri manusia sebab secara konstitusional telah dijamin UUD NRI 1945 maupun regulasi lainnya. Dalam upaya melindungi anak dari perdagangan manusia, Indonesia telah meratifikasi Konvensi Hak Anak melalui Keputusan Presiden No. 36 Tahun 1990 dan mengesahkan beberapa undang-undang terkait perlindungan anak. Meskipun demikian, perdagangan anak masih menjadi masalah serius yang melibatkan jaringan sindikat nasional dan internasional. Penelitian ini bertujuan untuk mengkaji dan menganalisis pemidanaan pelaku tindak pidana perdagangan anak serta aspek perlindungan hukum bagi anak korban. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif dengan pendekatan. Hasil penelitian menunjukkan bahwa meskipun regulasi hukum telah cukup komprehensif, implementasi dan penegakan hukum masih menghadapi berbagai kendala, termasuk kurangnya kesadaran masyarakat dan lemahnya koordinasi antar lembaga penegak hukum./ This research discusses the legal protection of minors trafficked in Indonesia, with a case study on the decision of the Manado High Court No. 10/PID/2021/TN MND. Children's human rights are an inseparable aspect of human beings because they are constitutionally guaranteed by the 1945 Constitution of the Republic of Indonesia and other regulations. In an effort to protect children from human trafficking, Indonesia has ratified the Convention on the Rights of the Child through Presidential Decree No. 36 of 1990 and passed several laws related to child protection. Despite this, child trafficking is still a serious problem involving national and international syndicate networks. This study aims to review and analyze the criminalization of child trafficking perpetrators as well as aspects of legal protection for child victims. This research is a normative legal research that is descriptive with an approach. The results of the study show that although legal regulations have been quite comprehensive, the implementation and enforcement of laws still face various obstacles, including lack of public awareness and weak coordination between law enforcement agencies.
