Abstract

Konstruksi sebagai salah satu bagian dari pekerjaan yang diakui oleh hukum di Indonesia juga melalui hubungan hukum yang sama. Bahwa dalam industri konstruksi terdapat pemberi kerja dan pekerja yang terikat di dalamnya. Hukum ketenagakerjaan akan berlaku juga di dalam industri konstruksi sebagai bagian yang tidak dapat dipisahkan dalam suatu hubungan industrial. Sehingga timbul permasalahan mengenai pelaksanaan kewajiban kontraktor terhadap pekerja bangunan mengenai keselamatan dan kesehatan kerja bagi pekerja bangunan di PT. Gelora Intan Reksa dan peran pemerintah dalam memastikan kepatuhan SMK3 dan sanksi yang diberlakukan jika ditemukan pelanggaran mengenai kesehatan dan keselamatan kerja. Penelitian ini menggunakan teori kepastian hukum dan perlindungan sebagai untuk menemukan jawaban dari permasalahan yang ada. Metode penelitian menggunakan metode penelitian hukum normatif dengan data sekunder yang menggunakan bahan hukum primer, sekunder, dan tersier. Pemberi kerja atau kontraktor memiliki kewajiban untuk menerapkan SMK3 dalam usahanya. Hal ini adalah mengenai sistem manajemen perusahaan yang memuat K3. Selain K3, perusahaan juga harus menjamin kewajiban sosial tenaga kerja bagi pekerjanya. Pemerintah berperan dalam menciptakan aturan, mengawasi, memberikan fasilitas keringanan untuk K3, dan memberikan sanksi terhadap pelanggaran yang tercipta. SMK3 sebagaimana telah dijelaskan, haruslah dimuat dalam sistem manajemen perusahaan, salah satu bentuknya adalah peraturan yang mengimplementasikan SMK3. Hal ini diperlukan sebagai wujud kepatuhan PT. Gelora Intan Reksa terhadap penerapan SMK3 pada sistem manajemen perusahaan PT. Gelora Intan Reksa. Maka, diperlukan adanya peraturan yang mendukung mengenai konsep keberlakuan SMK3 secara tertulis dalam mendukung kepastian hukum atas penerapan SMK3 pada PT. Gelora Reksa Intan. So problems arise regarding the implementation of the contractor's obligations towards construction workers regarding occupational safety and health for construction workers at PT. Gelora Intan Reksa and the government's role in ensuring SMK3 compliance and the sanctions imposed if violations regarding occupational health and safety are found. This research uses the theory of legal certainty and protection to find answers to existing problems. The research method uses legal normative research methods with primary secondary data using primary, secondary and tertiary legal materials. Employers or contractors have an obligation to implement SMK3 in their business. This is regarding the company management system which contains K3. Apart from K3, companies must also guarantee the social obligations of labor for their workers. The government plays a role in creating regulations, supervising, providing relief facilities for K3, and providing sanctions for violations that are created. SMK3, as has been explained, must be included in the company management system, one form of which is the regulations that implement SMK3. This is necessary as a form of PT compliance.
