Abstract
Di Indonesia sering terjadi Pemutusan Hubungan Kerja (PHK) secara sepihak oleh perusahaan, pada hakikatnya tindakan tersebut memberikan kerugian bagi pekerja karena tidak terpenuhinya hak pekerja yang diatur dalam hukum positif Indonesia. Rumusan masalah dalam skripsi ini adalah bagaimana perlindungan hukum terhadap hak-hak pekerja yang mengalami pemutusan hubungan kerja (PHK) sepihak berdasarkan hukum positif di Indonesia, dan bagaimana pertimbangan hukum hakim dalam pemutusan hubungan kerja (PHK) sepihak oleh perusahaan (studi putusan nomor: 328/Pdt.Sus-PHI/2023/PN Jkt.Pst). Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus. Data yang digunakan adalah data sekunder dan bahan hukum primer yang mencakup beberapa hukum, jurnal hukum serta peraturan perundang-undangan yang relevan dengan tujuan penelitian, yaitu untuk menganalisa perlindungan hukum terhadap hak pekerja yang mengalami pemutusan hubungan kerja secara sepihak dengan menganalisis putusan nomor: 328/Pdt.Sus-PHI/2023/PN.Jkt.Pst. Dari hasil penelitian ini menunjukkan bahwa perusahaan yang melakukan Pemutusan Hubungan Kerja secara sepihak harus memberikan ganti rugi berupa uang pesangon dan atau uang penghargaan masa kerja dan uang penggantian hak yang seharusnya diterima oleh pekerja. Melalui analisis putusan nomor: 328/ Pdt.Sus-PHI/2023/PN.Jkt.Pst disimpulkan bahwa pertimbangan Majelis Hakim telah didasarkan pada prinsip perlindungan hak pekerja dan prinsip keadilan yang sejalan dengan teori perlindungan hukum dan teori keadilan yang digunakan dalam penelitian ini. / In Indonesia, unilateral termination of employment (PHK) by companies often occurs, in essence this action causes losses to workers because of the non-fulfillment of workers' rights regulated in Indonesia's positive law. The formulation of the problem in this thesis is how to protect the legal rights of workers who experience unilateral termination of employment (PHK) based on positive law in Indonesia, and how to consider the legal considerations of judges in unilateral termination of employment (PHK) by companies (study decision number: 328/Pdt.Sus-PHI/2023/PN Jkt.Pst). This research is a normative legal research with a case approach. The data used are secondary data and primary legal materials that include several laws, legal journals and laws and regulations relevant to the purpose of the research, namely to analyze the legal protection of the rights of workers who experience unilateral termination of employment by analyzing the decision number: 328/Pdt.Sus-PHI/2023/PN.Jkt.Pst. The results of this study show that the company that unilaterally terminates the employment must provide compensation in the form of severance pay and/or service period award money and compensation money that should be received by the worker. Through the analysis of decision number: 328/ Pdt.Sus-PHI/2023/PN.Jkt.Pst, it was concluded that the judges' consideration was based on the principle of protection of workers' rights and the principle of justice which is in line with the theory of legal protection and the theory of justice used in this study.
