Abstract

Manusia sebagai makhluk hidup, memiliki berbagai macam kebutuhan yaitu kebutuhan primer seperti sandang, pangan, papan, maupun kebutuhan sekunder lainnya. Manusia harus melakukan pekerjaan agar mendapatkan upah untuk membeli kebutuhan hidup. Pekerjaan yang bersama pihak lain yaitu di perusahaan dan sering kali terjadi persoalan pembayaran upah dan juga persoalan mengenai pemutusan hubungan kerja karena tindakan sewenang-wenang pemilik perusahaan, kemudian terjadilah yang dinamakan perselisihan hubungan industrial. Rumusan masalah dalam skripsi ini adalah bagaimana cara penyelesaian perselisihan hubungan industrial antara pekerja dengan pihak manajemen PT. Solindo Genta Internasional berdasarkan Undang-undang Nomor 2 Tahun 2004 tentang penyelesaian perselisihan hubungan industrial dan bagaimana pelaksanaan asas kepastian hukum dalam putusan Mahkamah Agung Nomor 1245K/Pdt.Sus-PHI/2017. Penelitian ini merupakan penelitian hukum yuridis normatif yang mengkaji mengenai asas, teori, aturan dalam hukum dengan menelaah permasalahan tersebut. Data yang digunakan adalah data sekunder berupa bahan hukum primer: Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 2 Tahun 2004, Undang-Undang Nomor 13 Tahun 2013, Putusan Mahkamah Agung Nomor 1245K/Pdt.Sus-PHI/2017, sedangkan bahan hukum sekunder diperoleh dari buku-buku maupun literatur lainnya, bahan hukum tersier berupa kamus, kemudian disusun dan dianalisis. Dari hasil penelitian dapat disimpulkan bahwa penyelesaian perselisihan hubungan industrial ini dilakukan dalam 2 (dua) tahap yakni di luar dan di dalam pengadilan. Pada permasalahan pekerja dengan PT. Solindo Genta Internasional ini penyelesaiannya telah sesuai dengan yang diatur dalam UUPPHI, diawali dengan cara bipartite, tripartite, kemudian dilakukan upaya mediasi, selanjutnya proses penyelesaian ini dilakukan tahapan didalam pengadilan melalui Pengadilan Hubungan Industrial. Putusan hakim Mahkamah Agung dengan nomor 1245K/Pdt.Sus-PHI/2017 sudah sesuai dengan pertimbangan jeni-jenis pelanggaran hak dan PHK yang dilakukan PT. Solindo Genta Internasional terhadap para pekerja, putusan yang diberikan hakim juga telah memiliki kepastian hukum bagi para pekerja yang hak-haknya selama ini belum terpenuhi oleh pihak perusahaan. / Humans as living things, have various kinds of needs, namely primary needs such as clothing, food, shelter, and other secondary needs. Man must do work in order to earn wages to buy the necessities of life. Work with other parties is in the company and there are often problems with payment of wages and also problems regarding termination of employment due to arbitrary actions of company owners, then there is what is called industrial relations disputes. The formulation of the problem in this thesis is how to resolve industrial relations disputes between workers and the management of PT. Solindo Genta Internasional based on Law Number 2 of 2004 concerning the settlement of industrial relations disputes and how to implement the principle of legal certainty in the Supreme Court decision Number 1245K / Pdt.Sus-PHI / 2017. This research is a normative juridical law research that examines the principles, theories, rules in law by examining these problems. The data used are secondary data in the form of primary legal materials: Civil Code, Law Number 2 of 2004, Law Number 13 of 2013, Supreme Court Decision Number 1245K / Pdt.Sus-PHI / 2017, while secondary legal materials are obtained from books and other literature, tertiary legal materials in the form of dictionaries, then compiled and analyzed. From the results of the study, it can be concluded that the settlement of industrial relations disputes is carried out in 2 (two) stages, namely outside and inside the court. On the issue of workers with PT. Solindo Genta Internasional has settled in accordance with what is regulated in the UUPPHI, starting with bipartite, tripartite, then mediation efforts are made, then the settlement process is carried out in stages in the court through the Industrial Relations Court. The decision of the Supreme Court judge number 1245K / Pdt.Sus-PHI / 2017 is in accordance with the consideration of the types of rights violations and layoffs committed by PT. Solindo Genta Internasional against workers, the verdict given by the judge also has legal certainty for workers whose rights have not been fulfilled by the company.
