Abstract
ABSTRAK Judul : Perlindungan Hukum Terhadap Hak Pekerja Status Peserta Magang. Program pemagangan dalam negeri merupakan program yang dipersiapkan pemerintah yang di desain untuk mempersiapkan atau meningkatkan skill atau keahlihan bagi calon tenaga kerja berbasis pelatihan kerja, yang dalam hal ini memiliki hak-hak yang harus dilindungi bagi perusahaan yang menggunakan tenaga pemagangan yang diatur dalam Pasal 13 Peraturan Menteri Ketenagakerjaan No. 6 Tahun 2020, yang pada pokoknya Peserta Magang mempunyai hak mulai dari mendapatkan bimbingan instruktur, memperoleh fasilitas keselamatan dan kesehatan kerja, memperoleh uang saku, mendapatkan program jaminan sosial serta mendapatkan sertifikat. Fenomena penggunaan tenaga kerja dengan status magang terjadi di perusahan yang berada di Kabupaten Bekasi, pemagangan menjadi alternatif untuk mendapatkan cost upah yang rendah (upah murah), menghindari perselisihan hubungan industrial serta adanya kemudahan untuk menghentikan peserta magang jika tidak dibutuhkan sewaktu-waktu tanpa memberikan kompensasi apapun. Peraturan Daerah (Perda) Kabupaten Bekasi No. 4 Tahun 2016 Tentang Ketenagakerjaan telah mengatur norma-norma hukum yang harus ditaati perusahaan dalam menggunakan pemagangan, namun tampaknya Peraturan Daerah Kabupaten Bekasi ini masih memiliki banyak kelemahan sehingga perusahaan maupun lembaga pelatihan kerja masih melakukan pelanggaran terhadap hak-hak peserta magang. Jenis penelitian yang dipergunakan dalam penyusunan tesis ini ialah penelitian yuridis normatif (metode penelitian hukum normatif). Penelitian ini mengkaji dan menganalisis bahan-bahan pustaka berupa peraturan perundang-undangan dan literatur literatur yang berkaitan dengan permasalahan yang akan dibahas dalam penelitian ini. Hasil penelitian menyimpulkan regulasi mengenai pemagangan harus memberikan perlindungan hukum terhadap hak-hak peserta magang yang tidak membuat kebingungan atau ada dualisme peraturan, serta membuat regulasi terhadap pengawasan Peserta Magang dan memberikan wadah pelaporan yang penegakannya tidak terlalu panjang. Pengusaha harus bertanggung jawab memberikan rasa keadilan kepada peserta magang tidak boleh memperlakukan sama jenis pekerjaan peserta magang dengan karyawan pada umumnya namun lebih banyak memberikan pelatihan berbasis kerja, maka harus ada regulasi yang memberikan sanksi kepada pengusaha berupa pengangkatan karyawan tetap kepada peserta magang yang dipersamakan pekerjaannya dengan pekerja pada umumnya serta pembekuan sementara tidak bisa menerima Peserta Magang bagi perusahaan yang melanggar, sehingga ini dapat memberikan efek jera kepada perusahaan. The domestic apprenticeship program is a program prepared by the government which is designed to prepare or improve skills or expertise for prospective workers based on job training, which in this case has rights that must be protected for companies that use apprentices regulated in Article 13 of the Minister of Manpower Regulation No. 6 of 2020, which basically Apprentices have rights ranging from getting instructor guidance, obtaining occupational safety and health facilities, getting pocket money, getting social security programs and getting certificates. The phenomenon of using apprentices occurs in companies in Bekasi Regency, apprenticeship is an alternative to getting low wage costs (low wages), avoiding industrial relations disputes and the ease of stopping apprentices if they are not needed at any time without providing any compensation. Bekasi District Regional Regulation (Perda) No. 4 of 2016 concerning Manpower has regulated the legal norms that companies must comply with in using apprenticeships. However, it seems that this Bekasi District Regional Regulation still has many weaknesses so that companies and vocational training institutions still violate the rights of apprentices. The type of research used in the preparation of this thesis is yuridis normatif research (normative legal research method). This research examines and analyzes library materials in the form of legislation and literature related to the issues to be discussed. The results of the research conclude that regulations regarding apprenticeship must provide legal protection for the rights of apprentices that do not create confusion or dualism of regulations, as well as make regulations for the supervision of apprentices and provide a reporting platform whose enforcement is not too long. Employers must be responsible for providing a sense of justice to apprentices who should not treat the same type of work as apprentices with employees in general but provide more work-based training, then there must be regulations that impose sanctions on employers in the form of appointing permanent employees to apprentices who are equated with workers in general and temporary freezing cannot accept apprentices for companies that violate, so that this can have a deterrent effect on companies.
