Abstract

ABSTRAK Pendaftaran tanah adalah perlu dalam upaya menata dan mengatur peruntukan, penguasaan, kepemilikan, dan penggunaan tanah, termasuk untuk menyelesaikan berbagai masalah yang berkaitan dengan tanah. Pendaftaran tanah dimaksudkan untuk memastikan hak dan perlindungan hukum bagi pemilik tanah melalui pembuktian sertipikat tanah, mengatur kepemilikan dan penggunaan tanah, dan memberikan jaminan negara dan alat penting untuk melindungi pemilik tanah. Pendaftaran tanah bersifat rechtkadaster yang meliputi kegiatan Upaya pendaftaran tanah tidak segera ditingkatkan, maka kemungkinan akan muncul berbagai konflik dan sengketa pertanahan yang dapat mengganggu ketertiban sosial dan ekonomi. Program PTSL didirikan untuk mengatasi beberapa masalah tersebut dengan menyediakan kerangka kerja yang jelas dan terstruktur untuk pendaftaran tanah yang sistematis dan menyeluruh. Namun, dalam pelaksanaannya, program ini dapat menjadi sasaran bagi mafia tanah yang berupaya memanfaatkan celah dalam sistem untuk keuntungan pribadi mereka. Jenis penelitian yang dipergunakan ketika penyusunan tesis ialah penelitian yuridis normatif (metode penelitian hukum normatif). Penelitian hukum normatif ialah sebuah proses guna mencari sebuah peraturan, prinsip, ataupun doktrin hukum guna menyelesaikan masalah. Pelaksanaan penelitian hukum normatif guna menghasilkan argumentasi, teori atau konsep baru sebagai preskripsi dalam penyelesaian permasalahan. Penelitian ini menggunakan metode yuridis normatif, artinya penekanan pada ilmu hukum normatif, maka metode pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan (statute approach). Sebagai Kesimpulan, Pemberian jaminan kepastian hukum di bidang pertanahan khususnya Program Pendaftaran Tanah Sistematis Lengkap . Terdapat beberapa pengaturan terkait pendaftaran tanah, terkait lambatnya proses pembuatan sertifikat tanah, hal ini menjadi fokus perhatian pemerintah. Sebagai upaya mengatasi permasalahan tersebut, pemerintah melalui Kementerian ATR/BPN telah memperkenalkan Program Prioritas Nasional berupa Percepatan Pendaftaran Tanah Sistematis Lengkap (PTSL) yang diatur melalui Instruksi Presiden Republik Indonesia Nomor 2 Tahun 2018 mengenai Percepatan Pendaftaran Tanah Sistematis Lengkap di seluruh wilayah Indonesia, dengan tujuan agar proses sertifikasi tanah berjalan lebih cepat dan efisien Terkait pemberantasan mafia tanah dalam Program Pendaftaran Tanah Sistematis Lengkap, bahwa belum maksimal keberhasilan program ini tidak hanya bergantung pada aspek hukum, tetapi juga pada peran aktif negara dalam menjamin kesejahteraan dan keadilan sosial. Negara dan masyarakat perlu bersinergi dalam upaya memanfaatkan tanah untuk kemakmuran rakyat, melindungi hak-hak atas tanah, dan mencegah penyalahgunaan, sehingga dapat menciptakan sistem agraria yang lebih adil dan produktif Kata Kunci : Pendaftaran Tanah, Pendaftaran Tanah Sistematis Lengkap, Mafia Tanah. / ABSTRACT Land registration is essential for organizing and regulating the allocation, control, ownership, and use of land, as well as for resolving various land-related issues. Land registration aims to safeguard land owners' rights and legal protection by verifying land certificates, regulating land ownership and use, and offering state guarantees and crucial protection tools. Land registration is of aLand registration plays a crucial role in disaster management, encompassinFailure to immediately increase land registration efforts could lead to the emergence of various land conflicts and disputes, potentially disrupting social and economic order. We established the PTSL program to tackle these issues by offering a systematic and comprehensive framework for land registration. However, during its implementation, the land mafia may target this program, exploiting loopholes in the system for their own personal gain. Normative legal research, also known as the normative legal research method, forms the basis of a thesis. Normative legal research is the process of finding a regulation, principle, or legal doctrine to solve a problem. The implementation of normative legal research is to produce new arguments, theories, or concepts as prescriptions for solving problems. This research uses a normative legal method, meaning the emphasis is on normative legal science; the approach method used is the statute approach. In conclusion, the provision of legal certainty in the land sector, particularly through the Complete Systematic Land Registration Program, is crucial. The government is focusing its attention on several regulations related to land registration, which are related to the slow process of issuing land certificates. And to fix this issue, the government has set up a National Priority Program called Acceleration of Complete Systematic Land Registration (PTSL). This program is controlled by Presidential Instruction of the Republic of Indonesia Number 2 of 2018, which is about the Acceleration of Complete Systematic Land Registration throughout Indonesia. The goal is to make the land certification process go more quickly and easily.
