Abstract

ABSTRAK Selat malaka memiliki potensi bisnis yang berhubungan dengan keselamatan pelayaran, yaitu melalui jasa pemanduan. Keselamatan pelayaran di lingkungan perairan selat malaka tentunya haruslah diberikan pemanduan yang tepat agar tidak terjadinya kecelakaan di jalur sempit tersebut yang dipastikan dapat mengganggu jalur pelayaran dunia. Akibatnya akan banyak barang yang dikirim ke berbagai negara terlambat karena harus melewati jalur lain yang lebih panjang dan mengakibatkan kerugian pemilik kapal akan semakin banyak karena biaya operasional juga ikut membesar. Sebagai salah satu jalur pelayaran dunia selat malaka tetap harus terjaga keamaanan keselamatannya jangan sampai rusak dan merugikan dunia pelayaran untuk itu diperlukan tinjauan hukum yang dapat mengatasi permasalahan yang kemungkinan akan terjadi di selat malaka dan selat singapura dengan banyaknya angkutan kapal laut yang melewatinya sehingga para pemandu kapal dapat terjamin keselamatannya sebagaimana yang tertuang dalam Undang-Undang No.17 Tahun 2008 tentang Pelayaran. Penelitian ini menggunakan jenis penelitian yuridis normatif dilakukan dengan mempelajari bahan hukum utama seperti teori, konsep, dan asas-asas hukum serta peraturan perundang-undangan yang relevan dengan topik penelitian. Pendekatan ini juga disebut sebagai pendekatan peraturan perundang-undangan dan pendekatan konseptual, di mana peneliti mempelajari buku, peraturan perundang-undangan, dan dokumen lain yang relevan dengan topik penelitian sebelumnya. Kesimpulan dari Penelitian ini: pertama, pengaturan pemanduan kapal untuk keselamatan pelayaran terdapat didalam Undang-undang nomor 17 tahun 2008 tentang pelayaran serta diatur juga dalam Peraturan Menteri Perhubungan Nomor 57 Tahun 2015 tentang Pemanduan dan Penundaan Kapal. Adapun juga diatur dalam Regulasi Internasional seperti United Nation Convention on the Law of the Sea Tahun 1982 ( UNCLOS 1982) dan Konvesi Safety Of Life At Sea ( SOLAS) meskipun tidak diatur secara khusus terkait Pemanduan Kapal tetapi menjelaskan terkait keamanan dan keselamat di dunia pelayaran. Kedua, Kerjasama antara Indonesia, Malaysia, dan Singapura melalui Forum Tripartite Technical Expert Group (TTEG) untuk merumuskan pedoman pelaksanaan pemanduan kapal di Selat Malaka dan Selat Singapura merupakan langkah signifikan untuk keamanan dan keselamatan pelayaran. Adapun juga Kendala yang dihadapi terkait dengan batas-batas negara yang belum disepakati mencerminkan kompleksitas politik dan kepentingan nasional masing-masing negara terhadap Selat Malaka dan Selat Singapura. Dalam hukum internasional, penentuan batas-batas wilayah laut bisa menjadi sumber perselisihan antara negara-negara tetangga. Penyelesaiannya sering kali melibatkan negosiasi panjang, baik bilateral maupun melalui forum regional atau internasional. Kata Kunci : Pemanduan Kapal, Keselamatan Pelayaran. / ABSTRACT The Malacca Strait has business potential in terms of shipping safety, specifically through guiding services. Shipping safety in the Malacca Strait water environment must, of course, be given proper guidance so that accidents do not occur in this narrow lane, which can certainly disrupt world shipping lanes. As a result, many goods sent to various countries will be late because they have to go through other longer routes, which will result in more losses for ship owners because operational costs will also increase. We must maintain the Malacca Strait, one of the world's shipping lanes, to ensure its safety and prevent harm to the shipping industry. Therefore, a legal review is needed that can overcome the problems that are likely to occur in the Malacca Strait and Singapore Strait with the large number of ship transportations passing through them so that ship guides can be guaranteed safety as stated in Law No. 17 of 2008 concerning shipping. This research uses a type of normative juridical research conducted by studying primary legal materials such as theories, concepts, and legal principles as well as laws and regulations relevant to the research topic. This approach is also referred to as a statutory approach or conceptual approach, in which researchers study books, laws and regulations, and other documents relevant to the topic of previous research. The conclusion of this study is that, first, the regulation of ship guiding for shipping safety is contained in Law Number 17 of 2008 concerning shipping and also regulated in the Minister of Transportation Regulation Number 57 of 2015 concerning ship guiding and delaying. It is also regulated in international regulations such as the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the Safety of Life at Sea (SOLAS) Convention, although it is not specifically regulated in relation to ship guiding but explains related safety and security in the world of shipping. Secondly, the cooperation between Indonesia, Malaysia, and Singapore through the Tripartite Technical Expert Group (TTEG) Forum to formulate guidelines for the implementation of ship guiding in the Malacca Strait and Singapore Strait is a significant step for shipping security and safety. The difficulties encountered in relation to the unagreed boundaries reflect the political complexity and national interests of each country in the Malacca Strait and Singapore Strait. In international law, the determination of maritime boundaries can be a source of dispute between neighboring countries. Settlements often involve lengthy negotiations, either bilaterally or through regional or international forums. Keywords: Ship Guiding, Safety of the Sea.
