Abstract

Kontraktor Kontrak Kerja Sama (KKKS) PT. Golden Spike Energy Indonesia yang bergerak dalambidang pertambangan migas digugat pailit oleh PT.Global Pacific Energy yaitu perusahaan penunjang kegiatan hulu migas karena adanya utang yang sudah jatuh tempo dan belum terbayarkan. Gugatan diawali proses PKPU, perjanjian perdamaian, putusan dari Pengadilan Niaga, putusan pembatlaan pailit dari Mahkamah Agung, hingga putusan Peninjauan Kembali. Penelitian ini bersifat yuridis nonnatif, dengan menggunakan teori kepastian hukum, dimana hukum memberikan suatu kepastian hukum bagi para pihak yang bersengketa secara adil. Penelitia n ini mengurai Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang dan dikaitkan dengan teori-teorihukum dalam praktek pelaksanaannya sehubungan dengan kedudukan KKKS PT. Golden Spike Energy Indonesia yang menjadi pihak dalam kontrak kerja sama dengan Pemerintah Republik Indonesia dalam hal pengusahaan tambang minyak dan gas bumi. Permasalahan seperti ini yang menjadi inti penelitian, dimana kreditor dihadapkan dengan perusahaan nihil aset. Hasil penelitian menunjukan bahwa minimnya perlindungan terhadap kreditur pada KKKS Migas. KataKunci:Pailit,KontraktorKontrakKerjaSama(KKKS),SumberDayaAlam. / PT. Golden Spike Energy Indonesia (Contractor oil and Gas) which is engaged in oil and gas mining is sued for bankruptcy by PT. Global Pacific Energy (supporting company in oil and gas upstream) because of debts that are past due and unpaid. The lawsuit begins with the PKPU process, the accord agreement, the decision of the Commercial Court, the decision to cancel the bankruptcy of the Supreme Court, to the decision of the Judgment. This research is normative juridical, using legal certainty theory, where the law provides legal certainty for the parties in dispute fairly. This study parses Law Number 37 of 2004 concerning Bankruptcy and Deferral of Debt Payment Obligations and is associated with legal theories in the practice of its implementation in connection with the position of Contractor PT. Golden Spike Energy Indonesia, which is a party to the cooperation contract with the Government of the Republic of Indon esia for oil and gas mining. Problems like this are at the core of research, where creditors are confronted with zero-asset companies. The results showed that the lack of protection for creditors in the Oil and Gas Contractor.
