Abstract

Pelindungan merupakan (kata kerja) dan lebih tepat digunakan dalam hak cipta sebagai perbuatan untuk melindungi. Hak Cipta berawal dari ide yang diwujudkan dalam bentuk nyata kemudian mendapatkan hak eksklusif secara otomatis. Lembaga Manajemen Kolektif merupakan Lembaga yang berbentuk badan hukum nirlaba yang diberi kuasa oleh Pencipta, Pemegang Hak Cipta, guna mengelola hak ekonominya dalam bentuk menghimpun dan mendistribusikan royalti. Skripsi ini akan membahas pelindungan hukum tentang hak cipta atas lagu menurut Undang-undang Hak Cipta No. 28 Tahun 2014, dan mengenai pembayaran royalti hak cipta dibidang musik dan Lembaga Manajemen Kolektif dalam pemungutan royalti di indonesia. Penulisan skripsi ini menggunakan metode penulisan yuridis normatif dengan pendekatan bahan kepustakaan. Hak cipta memberikan konsep eksklusif sebagai hak yang hakikat dan alami yang dimiliki pencipta sehingga hak eksklusif itu menjadi jaminan untuk mendapatkan pelindungan hukum. Yayasan Karya Cipta Indonesia sebagai Lembaga manajemen kolektif yang mendapat izin operasi didasarkan kuasa yang diberikan oleh pencipta. Karena itu. / Protection is a verb and more precise to use in copyright as an act to protect. Copyright begin from the idea that manifested in real form and then automatically gain the exclusive rights. Collecting society is a non profit legal entity that authorized by creator and copyright holder to manage the economic rights in collect and distribute royalty. This thesis will discuss law protection about song copyright according to Copyright Law No. 28 of 2014. Also about copyright royalty payment in music and royalty collection in Indonesia by collecting society. Writing method in this thesis is juridical normative with bibliographic material approaches. Copyright gives an exclusive concept as an essence right owned by the creator so that exclusive rights become a guarantee to get law protection. Yayasan Karya Cipta Indonesia (KCI) is a Collecting society which get a operational license based on the authority that was given by the creator. Therefore KCI should give more socialization to the society.
