Abstract

Skripsi ini bertujuan untuk mengetahui sebab akibat yang terikat Perjanjian Kerja Waktu Tertentu atas Pemutusan Hubungan Kerja. Pelaksanaan suatu perjanjian kerja merupakan suatu bentuk pemenuhan hak dan kewajiban yang telah disepakati oleh para pihak. Namun, pada prakteknya tidak jarang ditemukan adanya pekerja yang tidak dapat menyelesaikan pekerjaannya hingga masa berlaku kontrak pada perjanjian kerja habis, sehingga pekerja dianggap merugikan perusahaan. Perjanjian kerja dapat berakhir karena beberapa alasan salah satunya apabila berakhirnya jangka waktu perjanjian kerja, Hal ini diatur di dalam Pasal 61 ayat (1) Undang-undang Ketenagakerjaan. Tujuan penulisan ini adalah untuk mengetahui pelaksanaan perjanjian kerja waktu tertentu serta akibat hukum dari pelaksanaan Pemutusan Hubungan Kerja diantara para pihak perjanjian kerja. Untuk menjawab permasalahan tersebut, maka tulisan ini menggunakan metode penelitian yuridis normatif dengan menggunakan metode pendekatan perundang-undangan, dan jenis bahan hukum primer dan sekunder yang dianalisis secara sistematis. Prinsip keadilan akan terpenuhi dengan jaminan pemenuhan perlindungan hukumnya dengan memperhatikan pihak yang lebih lemah posisinya, bahwa keadilan di sini harus menjamin kesejahteraan pekerja. Kata Kunci : Perjanjian Kerja, Pemutusan Hubungan Kerja, Keadilan. / This thesis aims to find out the cause and effect that is bound by a Specific Time Work Agreement for Termination of Employment. Implementation of an employment agreement is a form of fulfilling the rights and obligations agreed upon by the parties. However, in practice it is not uncommon to find workers who cannot complete their work until the contract validity period expires, so workers are considered detrimental to the company. Work agreements can terminate for several reasons, one of which is if the term of the work agreement is over. This is regulated in Article 61 paragraph (1) of the Manpower Act. The purpose of this paper is to determine the implementation of the work agreement for a certain time and the legal consequences of the termination of employment between the parties to the work agreement. To answer this problem, this paper uses normative juridical research methods using the legislative approach method, and the types of primary and secondary legal materials that are analyzed systematically. The principle of justice will be fulfilled by guaranteeing the fulfillment of its legal protection by taking into account the weaker party, that justice here must guarantee the welfare of workers.
