Abstract
Penelitian ini bertujuan untuk menganalisis konsep pengaturan pengupahan pekerja alih daya sebelum dan sesudah Undang-Undang Cipta Kerja (Omnibus Law klaster ketenagakerjaan) (Undang undang Nomor 6 Tahun 2023) dan menganalisis jaminan Hak Asasi Manusia (HAM) dalam pengupahan pekerja alih daya pada Undang-Undang Cipta Kerja. Penelitian ini merupakan penelitian yuridis normatif. Data yang digunakan adalah data sekunder berupa bahan hukum primer yaitu perundangundangan, bahan hukum sekunder, berupa berbagai buku yang relevan, karya tulisilmiah berupa jurnal hukum, artikel di dalam majalah, atau dan bahan hukum tersier berupa skripsi dan kamus yang relevan. Berdasarkan hasil penelitian dapat disimpulkan bahwa perubahan ketentuan yang mencolok pada undang Undang-Undang Cipta Kerja dalam unsur pengupahan adalah penghapusan ketentuan upah minimum sektoral yang kemudian digantikan dengan ketentuan pada Pasal 81 angka 26 Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja. Serta penghapusan 4 poin kebijakan dalam komponen pengupahan tenaga kerja. Dan undang-undang Cipta Kerja tidak memenuhi indikator indikator konvensi internasional yakni indikator kebebasan, ketersediaan, keteraksesan, dan kebersesuaian. Kata Kunci : Pengaturan Upah, tenaga alih daya, omnibus law. / This study aims to analyze the concept of wage arrangements for outsourced workers before and after the Job Creation Law (Omnibus Law on the employment cluster) (Law Number 6 of 2023) and analyze the guarantee of human rights in the wages of outsourced workers in the Job Creation Law. This research is a normative juridical research. The data used is secondary data in the form of primary legal materials, namely legislation, secondary legal materials, in the form of variousrelevant books, scientific papers in the form of legal journals, articles in magazines, or and tertiary legal materials in the form of theses and relevant dictionaries. Based on the results of the research, it can be concluded that the striking change in the provisions of the Job Creation Law in the wage element is the elimination of the sectoral minimum wage provisions which are then replaced by the provisions in Article 81 number 26 of Law Number 6 of 2023 concerning Job Creation. As well as the elimination of 4 policy points in the labor wage component. And the Job Creation law does not meet the indicators of international convention indicators, namely indicators of freedom, availability, accessibility, and compatibility.
