Abstract

Permasalahan penyelesaian sengketa tanah girik terkait jual beli yang didahului dengan pembuatan perjanjian pengikatan jual beli (PPJB) sering kali terjadi, misalnya ketika suatu tanah girik yang kemudian sudah dilakukan pemenuhan pembayaran tetapi tidak bisa dimiliki oleh pembeli karena objek sengketa antar ahli waris. Metode penelitian yang digunakan dalam penelitian ini adalah berupa yuridis normatif, adalah penelitian yuridis normatif membahas doktrin-doktrin atau asas-asas dalam ilmu hukum. Pihak pembeli disini telah dirugikan dengan adanya beberapa pihak ahli waris yang menolak untuk melaksanakan akta jual beli. Karena menurut ahli waris, tanah tersebut masih kepemilikan bersama dari para ahli waris keseluruhan. Maka penelitian ini dimaksudkan guna memahami perlindungan hukum bagi pembeli yang beritikad baik, keabsahan akta PPJB yang dibuat oleh para pihak dan bagaimana penyelesaian sengketa tanah girik. / The problem of resolving girik land disputes is related to buying and selling which is preceded by making a binding sale and purchase agreement (PPJB) often occur, for example when a girik land which is then made includes payment but cannot be owned by the buyer because the object is recorded between heirs. The research method used in this research is normative juridical, which is normative juridical research which discusses doctrines or principles in legal science. The buyer here has been disadvantaged by the presence of several heirs who refused to execute the sale and purchase deed. Because according to the heirs, the land is still jointly owned by the heirs. So, this research is intended to understand legal protection for buyers who have good intentions, the validity of the PPJB deed made by the parties and how to resolve girik land disputes.
