Abstract

Jual-beli online (E-Commerce) adalah transaksi jual-beli melalui media internet antara penjual dan pembeli yang terpisahkan jarak. Dalam proses jual beli tersebut sudah pasti memiliki aturan baku yang berfungsi sebagai batasan dalam praktik jual beli online. Perjanjian yang berlaku pada jual beli online sudah diatur secara rapi pada pasal-pasal yang berkaitan dengan ITE (Informasi dan Transaksi Elektronik) dan perlindungan konsumen untuk seluruh perusahaan e-commerce yang ada di Indonesia. Tokopedia merupakan salah satu perusahaan e-commerce yang paling populer oleh masyarakat Indonesia. Banyak sekali merchant yang menggantungkan penjualannya melalui Tokopedia, sehingga perusahaan tersebut harus memiliki legalitas hukum yang kuat untuk keberlangsungan perusahaan terkhusus pada pejanjian kerjasama dengan merchant serta bagaimana penyelesaian kendala bila terjadi kedepannya. Proses analisis perjanjian yang berlaku di Tokopedia menjadi bahasan penting karena kajian ini menjadi sumber referensi untuk mengetahui seperti apa bentuk penjajian kerjasama yang diberlakukan oleh sebuah perusahaan e-commerce khususnya tokopedia. Kemudian dalam penyelesaian masalah atau sengketa yang ada pada tokopedia akan secara saksama ditelusuri dengan teori kepastian hukum yang artinya menitik beratkan kepada pasal-pasal yang berlaku dan terikat pada setiap badan usaha. Metode dalam penelitian ini adalah normatif sehingga sifatnya pengamatan secara langsung kepada aturan�aturan yang sudah berlaku pada perusahaan Tokopedia. Secara aturan yang berlaku dan perjanjian antara Tokopedia dengan merchant, tokopedia sudah memenuhi semua syarat kelayakan dalam bermitra/kerjasama dan bertransaksi. Secara hukum apabila semua itu sudah terpenuhi maka Tokopedia memeiliki kekuatan hukum yang sah dan kuat. Dalam proses permasalahan yang terjadi pada perusahaan, Tokopedia sudah melakukan tidak lanjut penyelesaian yang sesuai dengan hukum yang berlaku secara umum. Meskipun begitu Tokopedia memiliki cara-cara sendiri sesuai standar perusahaan untuk melakukan penyeselaian masalah atau sengketa yang terjadi dengan secara terbuka lewat laporan ke customer care perusahaan. / Online transaction (E-Commerce) is an internet transaction between sellers and buyers who are separated by distance. Suring transaction process, it runs with standard rules that serve as border in online transaction practices. The agreement applies to online transaction has been neatly regulated in national regulation relating to ITE (Information and Electronic Transactions) and consumer protection for all e-commerce companies in Indonesia. Tokopedia is one of the most Indonesia popular e-commerce companies. Lots of merchants depend on their sales through Tokopedia, so the company must have strong legal legality for the sustainability of the company, especially in cooperation agreements with merchants and about how to solve problems if they occur in the future. The analysis process applies on Tokopedia is an important topic in order to be a source of reference to find out the kind of cooperation assessment is being imposed by an e-commerce company, especially Tokopedia. To solves problem exist in Tokopedia, writer will be traced carefully using theory of legal certainty, which means it will focus on the articles that apply and bounded to each business entity. This research method is normative, it is a direct observation of the existing rules in Tokopedia. According to the applicable rules and the agreement between Tokopedia and merchants, Tokopedia has met all the eligibility requirements for partnering / cooperation and transactions. Legally, if all of this has been fulfilled, so Tokopedia has legal and strong legal force. Tokopedia has carried out further settlement in accordance applicable law relate the process of problems that occur in the company. Even so, Tokopedia has its own ways according to company standards to solve problems or disputes that occur openly through reports to company via customer care.
