Abstract

Metode pembayaran Cash On Delivery (COD) menjadi favorit dikalangan masyarakat Indonesia karena dianggap efektif dalam mengurangi resiko penipuan dan memudahkan dalam proses pembayaran bagi yang tidak memiliki akses ke layanan pembayaran elektronik, akan tetapi faktanya terdapat beberapa hambatan terkait metode pembayaran Cash On Delivery (COD) yang dapat merugikan konsumen. Rumusan masalah dalam skripsi ini adalah apakah Undang-Undang Nomor 8 Tahun 1999 dapat melindungi konsumen yang mengalami kerugian dalam melakukan transaksi E-commerce serta bagaimana mekanisme penyelesaian sengketa yang merugikan konsumen E-commerce dalam metode pembayaran Cash On Delivery (COD). Jenis penelitian yang dipakai dalam penulisan ini yaitu penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach), serta memakai data sekunder berupa bahan hukum utama, sekunder dan tersier. Berdasarkan hasil penelitian bahwa Undang-Undang Nomor 8 Tahun 1999 tentang perlindungan konsumen belum sepenuhnya mampu melindungi konsumen dalam melakukan transaksi E-commerce dan penyelesaian sengketa yang dapat digunakan konsumen jika mengalami kerugian pada transaksi E-commerce dapat menggunakan penyelesaian sengketa melalui Badan Penyelesaian Sengketa Konsumen (BPSK), Pengadilan (litigasi) atau Alternatif Penyelesaian Sengketa (arbitrase, mediasi, konsiliasi, negosiasi, konsultasi dan penilaian ahli). Kata Kunci : Cash On Delivery, E-commerce, Perlindungan Konsumen, Alternatif Penyelesaian Sengketa. / The Cash On Delivery (COD) payment method is a favorite among Indonesian people because it is considered effective in reducing the risk of fraud and making the payment process easier for those who do not have access to electronic payment services. However, in fact there are several obstacles related to the Cash On Delivery (COD) payment method. which can harm consumers. The formulation of the problem in this thesis is whether Law Number 8 of 1999 can protect consumers who experience losses in carrying out E-commerce transactions and what is the mechanism for resolving disputes that harm E-commerce consumers using the Cash On Delivery (COD) payment method. The type of research used in this writing is normative juridical research using a statutory approach method, and using secondary data in the form of primary, secondary and tertiary legal materials. Based on research results, Law Number 8 of 1999 concerning consumer protection is not yet fully able to protect consumers in carrying out E-commerce transactions and dispute resolution that consumers can use if they experience losses in E-commerce transactions can use dispute resolution through the Consumer Dispute Resolution Agency (BPSK), Court (litigation) or Alternative Dispute Resolution (arbitration, mediation, conciliation, negotiation, consultation and expert assessment).
