Abstract

Pengangkutan memegang peran yang penting dalam kehidupan sehari-hari, pemanfaatan layanan pengangkutan barang telah menjadi kebutuhan mendasar bagi masyarakat dalam menjalankan transaksi jual beli, namun pihak pengangkut melakukan kelalaian pengiriman barang sehingga barang menjadi rusak. Kelalaian pengiriman barang oleh pihak pengangkut yang menyebabkan barang menjadi rusak, tentu saja merugikan konsumen. Adapun rumusan masalah yang digunakan dalam penelitian ini adalah bagaimana hak-hak hukum konsumen jika pihak pengangkut melakukan wanprestasi keterlambatan pengiriman barang sehingga barang menjadi rusak, dan bagaimana ganti rugi atas keterlambatan pengiriman barang sehingga barang menjadi rusak berdasarkan studi Putusan Nomor 151/Pdt.G/2020/PN JKT.SEL. Penulisan ini menggunakan penelitian yuridis normatif dengan pendekatan terhadap peraturan perundang-undangan dan studi kasus. Penggunaan jenis data dalam penelitian ini bersifat sekunder, melibatkan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian ini menunjukan bahwa hak-hak hukum konsumen jika pihak pengangkut melakukan wanprestasi keterlambatan pengiriman barang sehingga menjadi rusak adalah dengan melakukan gugatan wanprestasi sebagaimana yang diatur dalam Pasal 1234 KUHPerdata tentang Wanprestasi, Pasal 45 Ayat (1) dan Ayat (2) Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, Pasal 191, 196 Undang – Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Ganti rugi atas keterlambatan pengiriman barang sehingga barang menjadi rusak dalam putusan Nomor 151/Pdt.G/2020/PN JKT.SEL berdasarkan pasal 1234 KUHPerdata, ditetapkan oleh hakim sebesar 13.321.872.000,00,- (tiga belas milyar tiga ratus dua puluh satu juta delapan ratus tujuh puluh dua ribu rupiah). / Transportation plays an important role in everyday life and is an inseparable part of community activities. Utilizing goods transportation services has become a basic need for the community in carrying out business activities or making deliveries to a location. In this article, the author will discuss the legal steps that consumers can take if there is damage to the goods being transported as a result of delays in delivery of the goods. The problem formulation used in this research is what legal remedies can consumers take if the carrier defaults on late delivery of goods so that they become damaged, and how to compensate for late delivery of goods so that the goods become damaged based on a study of decision Number 151/Pdt.G/ 2020/PN JKT.SEL. The research method applied in this writing is normative juridical research with an approach to statutory regulations and case studies. The type of data used in this research is secondary, involving primary legal materials, secondary legal materials, and tertiary legal materials. The results of this research show that the legal action that consumers can take if the carrier is in default of late delivery of goods so that they become damaged is to file a lawsuit for default. as regulated in Article 1234 of the Civil Code concerning Default, Article 45 Paragraph (1) and Paragraph (2) of Law Number 8 of 1999 concerning Consumer Protection, Articles 191, 196 of Law Number 22 of 2009 concerning Road Traffic and Transportation. Compensation for late delivery of goods resulting in the goods being damaged in decision Number 151/Pdt.G/2020/PN JKT.SEL based on article 1234 of the Civil Code, was determined by the judge at 13,321,872,000.00,- (thirteen billion three hundred and twenty-one million eight hundred and seventy two thousand rupiah).
