Abstract
Praktek pelaksanaan PHK dengan menggunakan alasan terjadinya pelanggaran yang bersifat mendesak, sering terjadi tidak sesuai dengan Peraturan Perusahaan. Untuk itu skripsi ini membahas tentang masalah tersebut dari sisi UU Cipta Kerja guna melihat apakah putusan hakim terkait dengan masalah tersebut, yaitu Putusan Pengadilan Hubungan Industrial Nomor: 421/Pdt.SUS-PHI/2021/PN.JKT.PST telah sejalan dengan aturan perundang-undangan yang berlaku. Dalam penulisan skripsi ini penulis melakukan pendekatan hukum yang bersifat normatif dengan menggunakan data sekunder, yaitu berupa literasi-literasi yang terkait permasalahan hukum pada umumnya serta permasalahan tentang pemutusan hubungan kerja pada khususnya, serta juga menggunakan data hukum primer, yaitu aturan-aturan hukum yang terkait dengan permasalahan ini seperti UU No. 13 Tahun 2003 tentang Ketenagakerjaan, juga UU No. 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang, PP No. 35 Tahun 2021 dan Putusan PHI PN Jakarta Pusat Nomor: 421.Pdt.Sus-PHI/2021/PN.JKT.PST. / The practice of implementing Termination of Employment Relations using urgent reasons for violations often occurs which is not in accordance with Company Regulations. For this reason, this thesis discusses this issue from the perspective of the Job Creation Law in order to see whether the judge's decision is related to this issue, namely the Industrial Relations Court Decision Number: 421/Pdt.SUS-PHI/2021/PN.JKT.PST is in line with statutory regulations. - valid invitation. In writing this thesis the author took a normative legal approach using secondary data, namely in the form of literature related to legal issues in general and issues regarding termination of employment relations in particular, and also used primary legal data, namely related legal regulations. with this problem such as Law no. 13 of 2003 concerning Employment, also Law no. 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, PP No. 35 of 2021 and Central Jakarta District Court PHI Decision Number: 421.Pdt.Sus-PHI/2021/PN.JKT.PST.
