Abstract

Justice Collaborator merupakan salah satu pelaku tindak pidana tertentu, mengakui kejahatan yang dilakukannya bukan pelaku utama dalam kejahatan tersebut dan memberikan keterangan sebagai saksi di dalam proses peradilan. Kasus pembunuhan berencana yang melibatkan Brigadir Nofriansyah Yosua Hutabarat dan Richard Eliezer Pudihang Lumiu menjadi sorotan karena peran Richard Eliezer sebagai Justice Collaborator. Sebagai Justice Collaborator, Richard Eliezer memberikan keterangan sebagai saksi yang bekerja sama dalam mengungkapkan fakta-fakta terkait kasus pembunuhan tersebut. Jenis penelitian yang digunakan adalah penelitian kepustakaan yang mencari dan menganalisis jawaban atas permasalahan yang diangkat berdasarkan norma-norma hukum sistematika guna memuat aturan tentang perlindungan bagi Justice Collaborator. Landasan hukum dan lembaga perlindungan memberikan jaminan bahwa kontribusi Justice Collaborator dihargai dan bahwa mereka dapat memberikan kesaksian tanpa takut akan ancaman atau gangguan. Perlindungan ini sejalan dengan prinsip hak asasi manusia dan keadilan dalam sistem hukum Indonesia. Namun, masih ada kekurangan dalam hal penetapan seorang Justice Collaborator dalam kasus tertentu, seperti kasus pembunuhan berencana yang melibatkan Richard Eliezer belum berjalan dengan maksimal karena kurangnya aturan yang mengatur persyaratan secara tegas. Hal ini menimbulkan ketidakpastian dalam penetapan seseorang sebagai Justice Collaborator, sehingga perlindungan dan peran mereka dalam proses peradilan pidana masih memerlukan pengembangan lebih lanjut. Namun Putusan Pengadilan yang menetapkan hukuman penjara selama 1 tahun 6 bulan kepada Richard Eliezer, menunjukkan keseimbangan antara keadilan dan pertimbangan Hakim. Penetapan Terdakwa sebagai justice collaborator memberikan penghargaan atas kontribusinya, mencerminkan penghargaan terhadap kejujuran dan kerjasama. Meskipun hal ini tidak selalu sesuai dengan apa yang didalilkan oleh penuntut umum. Hal ini menunjukkan bahwa Hakim tidak hanya bertugas memutuskan suatu perkara secara normatif saja, melainkan juga wajib menggali, mengikuti dan memahami nilai-nilai hukum dan rasa keadilan yang hidup dalam masyarakat, sebagaimana diatur dalam Pasal 5 ayat (1) Undang-undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman. / Justice Collaborator is one of the perpetrators of certain criminal acts, ad- mits to the crime he committed is not the main perpetrator in the crime and provides testimony as a witness in the judicial process. The premeditated murder case involv- ing Brigadier Nofriansyah Yosua Hutabarat and Richard Eliezer Pudihang Lumiu was in the spotlight because of Richard Eliezer's role as Justice Collaborator. As Justice Collaborator, Richard Eliezer provided testimony as a witness who collabo- rated in revealing the facts related to the murder case. The type of research used is library research which seeks and analyzes answers to problems raised based on systematic legal norms in order to contain rules regarding protection for Justice Collaborators. Legal foundations and protective institutions provide assurance that Justice Collaborators' contributions are valued and that they can provide testimony without fear of threats or harassment. This protection is in line with the principles of human rights and justice in the Indonesian legal system. However, there are still shortcomings in terms of determining a Justice Collaborator in certain cases, such as the premeditated murder case involving Richard Eliezer which has not been carried out optimally due to the lack of regulations that clearly regulate the requirements. This creates uncertainty in determining someone as a Justice Collaborator, so that their protection and role in the criminal justice process still requires further de- velopment. However, the Court's decision which imposed a prison sentence of 1 year and 6 months on Richard Eliezer, shows a balance between justice and the judge's consideration. Determining the Defendant as a justice col- laborator provides recognition for his contribution, reflects appreciation for honesty and cooperation. Although this is not always in accordance with what is argued by the public prosecutor. This shows that judges are not only tasked with deciding a case normatively, but are also obliged to explore, follow and understand the legal values and sense of justice that exist in society, as regulated in Article 5 paragraph (1) of Law Number 48 2009 con- cerning Judicial Power
