Abstract

Berdasarkan Data diatas dari Tahun 2019 dari jumlah Penduduk pengguna sebanyak 1,80% sampai Tahun 2021 naik menjadi 1,95%, pada waktu 2 Tahun pengguna bertambah sebanyak 536.330 jiwa. peredaran-peredaran Narkotika Jenis baru, Badan Narkotika Nasional pada Tahun 2020 menyatakan bahwa sudah ada 893 (delapan ratus sembilan puluh tiga) Jenis Narkotika terbaru atau NPS (New Psychoactive Substance) yang beredar di Dunia dan sebanyak 77 (tujuh puluh tujuh) NPS sudah masuk dan beredar di Indonesia dan 73 (tujuh puluh tiga) dari 77 (tujuh puluh tujuh) NPS sudah diatur dan masuk kedalam Peraturan Menteri Kesehatan (PERMENKES). 4 (empat) dari 77 (tujuh puluh tujuh) tersebut belum masuk kedalam Lampiran PERMENKES. Hal ini yang membuat kelemahan dalam implementasi UU Narkotika dan PERMENKES. Rumusan Masalah Skripsi ini adalah Keberlakuan Undang-undang Nomor 35 Tahun 2009 Tentang Narkotka Terhadap Narkotika Jenis Baru dan Bagaimana Pertanggungjawaban Pidana bagi Pelaku Tindak Pidana Narkotika yang Golongan Narkotikanya belum diatur dalam PERMENKES dan Lampiran I Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika. Metode yang digunakan Penulis dalam Penelitian ini menitik beratkan pada pengungkapan masalah yaitu metode Yuridis Normatif. Penelitian ini dilakukan melalui penelitian kepustakaan, dan bahan penelitian diambil dari bahan bacaan yang memberikan gambaran dan pengetahuan tentang topik yang dibahas, Undang-undang Nomor 35 Tahun 2009 Tentang Narkotik, Peraturan Kementrian Kesehatan Republik Indonesia (PERMENKES), Instruksi Presiden Republik Indonesia Nomor 2 Tahun 2020 Tentang Pencegahan dan Pemberantasan penyalahgunaan dan pe redaran gelap narkotika dan prekusor narkotika, Laporan Informasi Badan Narkotika Nasional Nomor: LI/02/I/Sin Tertanggal 12 Juni 2013 tentang Laporan Tindak Pidana Narkotika Dari hasil Penelitian ini dapat disimpulkan bahwa Undang-undang Narkotika sulit berhadapan dengan pelaku penyalahgunaan Narkotika baru dikarenakan Adanya Asas Legalitas yang menghalanginya, sehingga cara terakhir adalah menggunakan cara Restorative Justice yang dimana pengguna akan dilaksanakan rehabilitasi sehingga adanya Pemulihan Hukum untuk masa yang akan mendatang. / Based on the above data from 2019, the number of user population is 1.80% until 2021 it will increase to 1.95%, in 2 years the number of users will increase by 536,330 people. circulation of new types of Narcotics, the National Narcotics Agency in 2020 stated that there were already 893 (eight hundred and ninety three) new types of Narcotics or NPS (New Psychoactive Substance) circulating in the World and as many as 77 (seventy seven) NPS had entered and circulating in Indonesia and 73 (seventy three) of the 77 (seventy seven) NPS have been regulated and included in the Minister of Health Regulation (PERMENKES). 4 (four) of the 77 (seventy seven) have not been included in the PERMENKES Appendix. This has created weaknesses in the implementation of the Narcotics Law and the PERMENKES. The problem formulation of this thesis is the Applicability of Law Number 35 of 2009 concerning Narcotics Against New Types of Narcotics and How Criminal Liability for Narcotics Offenders whose Narcotics Classification has not been regulated in PERMENKES and Appendix I of Law Number 35 of 2009 concerning Narcotics The method used by the author in this study focuses on disclosing the problem, namely the Normative Juridical method. This research was conducted through library research, and research materials were taken from reading materials that provide an overview and knowledge of the topics discussed, Law Number 35 of 2009 concerning Narcotics, Regulation of the Ministry of Health of the Republic of Indonesia (PERMENKES), Instruction of the President of the Republic of Indonesia Number 2 of 2009 2020 Concerning the Prevention and Eradication of the abuse and illicit circulation of narcotics and narcotics precursors, Information Report of the National Narcotics Agency Number: LI/02/I/Sin dated 12 June 2013 concerning Reports of Narcotics Crime From the results of this study it can be concluded that the Narcotics Law is difficult to deal with new perpetrators of Narcotics abuse because of the Legality Principle which hinders them, so the last way is to use the Restorative Justice method where users will be carried out rehabilitation so that there is Legal Recovery for the future.
