Abstract

Latar Belakang: Hubungan antara dokter dan pasien di satu pihak dokter yang sehat dan ahli di bidangya sementara itu pihak pasien yang dalam keadaan sakit dan awam mengenai penyakit. Pentingya hak-hak konsumen berdasarkan UndangUndang No. 8 Tahun 1999 dipandang oleh ahli hukum adalah merupakan hal utama yang akan dibahas dalam tesis ini dan dapat diterapkan terutama pada profesi kedokteran dan profesi advokat. Metode Penelitian: Jenis penelitian yang digunakan dalam penulisan hukum ini adalah penelitian hukum normatif, dengan pendekatan penelitian mengunakan perundang-undangan, konsep dan jenis sumber data dengan data sekunder serta teknik analisis data secara deskriptif kualitatif. Pembahasan: Penelitian ini mengkaji hubungan dokter dan pasien dalam perspektif undang-undang perlindungan konsumen, selanjutnya tentang kerugian pasien atas tindak medis secara umum, selanjutnya akan meninjau tentang tanggung jawab hukum dokter dari perlindungan konsumen secara perdata. Kesimpulan: Terdapat hubungan asimetris antara dokter dan pasien, dan dibutuhkan undang-undang yang dapat melindungi pihak konsumen. Tanggung jawab dokter, telah diatur dalam kode etik kedokteran, tanggung jawab pidana dapat muncul apabila dibuktikan adanya perbuatan yang tidak sesuai. Kata kunci: Perlindungan konsumen, pelayanan kesehatan dan tenaga medis (dokter). / Background: The relationship between a doctor and a patient is one in which the doctor is healthy and an expert in his field, while the patient is sick and unfamiliar with the disease. The importance of consumer rights based on Law No. 8 of 1999 as viewed by legal experts is the main thing that will be discussed in this thesis and can be applied especially to the medical profession and the advocate profession. Research Method: The type of research used in this legal writing is normative legal research, with a research approach using legislation, concepts, and types of data sources with secondary data and descriptive qualitative data analysis techniques. Discussion: This research examines the relationship between doctors and patients in the perspective of consumer protection laws, then about patient losses for medical acts in general, then will review the legal responsibility of doctors from civil consumer protection. Conclusion: There is an asymmetrical relationship between doctors and patients, and there is a need for laws that can protect consumers. The responsibility of doctors, has been regulated in the medical code of ethics, criminal responsibility can arise if it is proven that there is an inappropriate act.
