Abstract

Karya musik atau lagu adalah satu dari banyaknya karya yang telah melekat Hak Cipta serta terdapat hak moral dan hak ekonomi. Tetapi ada dampak negatif dari adanya kemudahan dalam mengakses karya musik, dengan adanya oknum-oknum tertentu yang memanfaatkan celah dalam kemajuan teknologi untuk keuntungan pribadi. Rumusan masalah pada skripsi ini adalah bagaimana legalitas pembuatan lagu cover yang dipublikasikan di Platform Youtube, dan bagaimana perlindungan hukum bagi pencipta lagu yang karyanya dipublikasikan melalui perbuatan lagu cover di Platform Youtube berdasarkan Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta. Jenis penelitian hukum yang dilakukan adalah penelitian yuridis normatif. Dalam penelitian ini bahan hukum primer yang digunakan terdiri dari Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 tentang Hak Cipta dan Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik.Dari hasil penelitian ini dapat disimpulkan bahwa perlindungan hukum terhadap pemegang hak cipta atas pelanggaran hak cipta di bidang musik dan lagu dalam bentuk cover version yang dikomersilkan dapat dilakukan melalui dua cara yaitu upaya preventif dan upaya represif. Upaya preventif yaitu dengan melakukan pencatatan ciptaan seperti diatur dalam Pasal 66-67 UU Hak Cipta. Upaya represif yaitu melalui penyelesaian sengketa arbitrase atau pengadilan. / One of the various types of works with copyright and moral, economic, and other rights is music or songwriting. The ease of getting music does have a downside, too, since some people use the gaps in technological development for their own gain. The question that this thesis seeks to answer is how, under Law No. 28 of 2014 Concerning Copyright, the legality of making cover songs published on the Youtube Platform and how the legal protection for songwriters whose works are published through the act of covering songs on the Youtube Platform are based. It is a form of normative juridical study that is being done. Law of the Republic of Indonesia Number 28 of 2014 about copyright and Law of the Republic of Indonesia Number 11 of 2008 regulating information and electronic transactions were the main legal documents used in this study. From the study's findings, it can be inferred that there are two methods that legal protection for copyright holders can be implemented to address copyright infringement in the sphere of music and songs in the form of commercialized cover versions: preventive measures and repressive efforts. Articles 66–67 of the Copyright Law call for documenting creations as part of preventive measures. Repressive measures, particularly using arbitration or the legal system to resolve disputes.
