Abstract

ABSTRAK Tindakan korupsi yang dilakukan oleh korporasi juga mengakibatkan berbagai macam kerugian termasuk kerusakan pada alam dengan banyaknya kerusakan yang dialami akibat polusi dan eksploitasi yang berlebihan antara lain disebabkan oleh mudahnya korporasi memperoleh ijin dan lemahnya pengawasan oleh pemerintah. Adapun rumusan masalah dalam penelitian ini yaitu: (1) Mengapa perlu dilakukan upaya pencegahan penyalahgunaan wewenang dalam menanggulangi tindak pidana korupsi dalam sumber daya alam di bidang pertambangan berdasarkan pada Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan? dan (2) Bagaimana strategi sinkronisasi vertikal dan horizontal tindak pidana korupsi dalam sumber daya alam di bidang pertambangan berdasarkan pada Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan?. Jenis penelitian yang dipergunakan ketika penyusunan tesis ialah penelitian yuridis normatif (metode penelitian hukum normatif). Penelitian ini mengkaji dan menganalisis bahan-bahan pustaka berupa peraturan perundang-undangan, putusan pengadilan, dan literatur-literatur yang berkaitan dengan permasalahan yang akan dibahas. Metode pendekatan masalah berbeda dengan metode atau tipe penelitian dalam upaya memecahkan permasalahan yang diambil. Dari hasil penelitian di peroleh bahwa Upaya pencegahan dan pemberantasan korupsi di sektor sumber daya alam, khususnya di bidang pertambangan, sangat penting dalam mencapai tata kelola sumber daya alam yang bersih dan transparan. Oleh karena itu, sangat penting untuk menggalang komitmen dari seluruh pemangku kepentingan untuk mewujudkan upaya tersebut. Selanjutnya, Strategi sinkronisasi vertikal pada pencegahan dan pemberantasan tindak pidana korupsi di bidang sumber daya alam sangat diperlukan saat ini, sebagaimana diketahui bahwa masih banyak terjadi tumpang tindih peraturan perUndang-Undangan, hal ini menjadikan celah bagi masuknya tindak pidana korupsi. Adapun sinkronisasi horizontal juga perlu untuk melakukan pencegahan dan pemberantasan korupsi, yang mana sinkronisasi horizontal harus tumbuh dari diri masing-masing pimpinan dalam sub-sub sistem dalam sistem peradilan pidana dengan niat dan komitmen untuk memberantas tindak pidana korupsi serta diperlukannya sinkronisasi dalam peraturan perUndang-Undangan yang setara Kata Kunci: Pencegahan, Tindak Pidana Korupsi, dan Pertambangan. / ABSTRACT Corrupt acts committed by corporations also result in various kinds of losses including damage to nature with the amount of damage experienced due to pollution and excessive exploitation, among others, caused by the ease of corporations obtaining licences and weak supervision by the government. The problem formulations in this study are: (1) Why is it necessary to prevent abuse of authority in tackling criminal acts of corruption in natural resources in the mining sector based on Law No. 30 of 2014 concerning Government Administration? and (2) How is the vertical and horizontal synchronisation strategy of criminal acts of corruption in natural resources in the mining sector based on Law No. 30 of 2014 concerning Government Administration. The type of research used when preparing the thesis is normative juridical research (normative legal research method). This research examines and analyses library materials in the form of laws and regulations, court decisions, and literature related to the problems to be discussed. The method of approaching the problem is different from the method or type of research in an effort to solve the problems taken.. From the research results, it is found that efforts to prevent and eradicate corruption in the natural resources sector, especially in the mining sector, are very important in achieving clean and transparent natural resource governance. Therefore, it is very important to mobilise the commitment of all stakeholders to realise these efforts. Furthermore, a vertical synchronisation strategy on the prevention and eradication of corruption in the field of natural resources is needed at this time, as it is known that there are still many overlapping laws and regulations, this makes a gap for the entry of corruption. Horizontal synchronisation is also necessary for the prevention and eradication of corruption, where horizontal synchronisation must grow from each leader in the sub-systems in the criminal justice system with the intention and commitment to eradicate corruption and the need for synchronisation in equivalent laws and regulations.
