Abstract

Pemberian Justice Collaborator baru pertama kali diterapkan dalam kasus tindak pidana umum, yaitu dalam kasus penghilangan nyawa atau pembunuhan yang terjadi pada tahun 2022, dengan korban jiwa yaitu seorang anggota kepolisian yaitu Brigadir Polisi Nofriansyah Yosua Hutabarat atau lebih dikenal dengan Brigadir J (selanjutnya disebut “Yosua”), dimana saat pengusutan kasus tersebut berada dalam tahapan penyelidikan di kepolisian, salah satu orang yang diduga sebagai pelaku penghilangan nyawa tersebut, yaitu seorang anggota kepolisian berpangkat Bharada, bernama Richard Eliezer Pudihang Lumiu, atau lebih dikenal dengan sebutan Bharada Eliezer alias Bharada E (selanjutnya disebut “Eliezer”), diberikan status JC atau Justice Collaborator. Metode penelitian penulisan tesis ini berjenis metode penelitian yuridis normatif atau hukum normatif. Pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statua approach) dan studi kasus/putusan (case study). Dari hasil penelitian yang di peroleh bahwa, Bahwa penerapan status Saksi Pelaku Yang Bekerja Sama (Justice Collaborator) dalam yang Perkara Nomor 798/Pid.B/2022/PN.Jkt.Sel yang diadili oleh Majelis Hakim pada Pengadilan Negeri Jakarta Selatan belum berjalan dengan maksimal mengingat beberapa pertimbangan Majelis Hakim dalam menetapkan status Terdakwa Richard Elieazer Pudihang Lumiu sebagai Saksi Pelaku Yang Bekerja Sama (Justice Collaborator), disusun di atas dasar hukum yang belum tepat akibat ketiidaksediaan atau belum adanya aturan tegas yang mengatur beberapa elemen penting dalam persyaratan penetapan seseorang sebagai JC, antara lain, aturan tegas yang memisahkan dan membedakan jenis “tindak pidana tertentu” dengan definsi “tindak pidana kasus tertentu”. Selanjutnya, Penetapan dan Penghargaan sebagai JC yang berlandaskan SEMA No 4Tahun 2011, yang seharusnya diberikan dan diterapkan pada kejahatan-kejahatan terorganisir dan terkategori dalam tindak pidana khusus dan atau atau tertentu, tidak semestinya dapat diterapkan secara serta merta dalam kejahatan atau tindak pidana umum manakala landasan hukum yang memiliki batasan tegas atas syarat-syarat penetepan JC dalam SEMA tersebut, belum diterbitkan Kata Kunci: Justice Collaborator, Tindak Pidana, dan Tindak Pidana Pembunuhan Berencana. / The granting of Justice Collaborator was first applied in a general criminal case, namely in a case of disappearance of life or murder that occurred in 2022, with the victim being a police officer, Brigadier Police Nofriansyah Yosua Hutabarat or better known as Brigadier J (hereinafter referred to as "Yosua"), where when the investigation of the case was in the investigation stage in the police, one of the people suspected of being the perpetrator of the disappearance, namely a police officer with the rank of Bharada, named Richard Eliezer Pudihang Lumiu, or better known as Bharada Eliezer alias Bharada E (hereinafter referred to as "Eliezer"), was granted JC or Justice Collaborator status. The research method of writing this thesis is a normative juridical or normative legal research method. The research approaches used in this research are statutory approach and case study. From the results of the research obtained that, the application of the status of Witnesses of Cooperating Actors (Justice Collaborator) in Case Number 798/Pid.B/2022/PN.Jkt. Sel tried by the Panel of Judges at the South Jakarta District Court has not been running optimally considering that several considerations of the Panel of Judges in determining the status of the Defendant Richard Elieazer Pudihang Lumiu as a Cooperating Witness (Justice Collaborator), were prepared on an inappropriate legal basis due to the unavailability or absence of strict rules governing several important elements in the requirements for determining a person as a JC, among others, strict rules that separate and distinguish the type of "certain criminal offences" from the definition of "certain criminal cases". Furthermore, the determination and award as JC based on SEMA No. 4 Year 2011, which should be given and applied to organised crimes and categorised in special criminal offences and / or or certain, should not be able to be applied immediately in general crimes or criminal offences when the legal basis that has strict limits on the requirements for the determination of JC in the SEMA, has not been published.
