Abstract

PERLINDUNGAN HUKUM TERHADAP INVESTOR PADA APPLIKASI INVESTASI SAHAM BERBASIS ONLINE Perkembangan Teknologi yang semakin canggih saat ini ikut mempengaruhi sektor perekonomian di Indonesia, terkhusus kepada digitalisasi keuangan. Melalui perkembangan teknologi yang dapat memudahkan seseorang melakukan kegiatan berinvestasi secara online melalui beberapa platform atau applikasi berbasis online yang sudah banyak tersedia. Beberapa diantaranya juga memberikan peluang adanya tindak kejahatan sebagaimana kegiatan berinvestasi ini dikenal ada yang dapat dilakukan secara legal maupun illegal. Apalagi saat ini untuk menyebarkan suatu informasi sangatlah mudah dengan menggunakan media online, sehingga para pelaku dengan mudah mempromosikan investasi saham ilegal ini kepada masyarakat dengan menjanjikan suatu keuntungan besar yang sudah pasti. Kebanyakan orang akan tergiur dengan iming-iming keuntungan besar tersebut tanpa peduli dengan resiko yang datang nantinya,itulah mengapa muncul fenomena investasi ilegal berbasis online. kepastian hukum ketika peraturan perundang-undangan tersebut diciptakan serta diundangkan dengan memerhatikan dan mempertimbangkan asas kepastian hukum maka akan terwujud suatu aturan yang jelas. Metode yang diterapkan dalam penelitian hukum ini adalah kajian metode penelitian yuridis normative, yang mengacu pada penelitian analisis subtansi dari peraturan perundang-undangan, buku-buku, jurnal dan makalah serta yurisprudensi lainnya. Penelitian normative dikarenakan spesifikasi penelitian lebih banyak dibuat pada petunjuk yang bersifat sekunder yang ada di perpustakaan. Menurut UUPM ada beberapa penyelesaian Sengketa dalam Investasi Online atas Aplikasi Investasi Saham Yang Marak dan Berkembang Saat ini : 1. Penyelesaian Secara Musyawarah Mufakat, 2. Penyelesaian Melalui Arbitrase 3. Penyelesaian melalui Alternatif Penyelesaian Sengketa dan Penyelesaian Melalui Pengadilan, mana perlindungan hukum dapat diberikan kepada investasi: Hukum Investasi, Perlindungan Kontrak, Perlindungan Hak Kepemilikan, Transparansi dan Pengungkapan, Perlindungan terhadap Penipuan, Hak-hak Minoritas, Pengaturan Pasar Keuangan Kata Kunci: Perlindungan Hukum Investor, Penyelesaian Perkara Investasi Online. / ABSTRACT LEGAL PROTECTION OF INVESTORS IN ONLINE-BASED STOCK INVESTMENT APPLICATIONS The development of increasingly sophisticated technology is currently affecting the economic sector in Indonesia, especially the digitization of finance. Through technological developments that can make it easier for someone to invest online through several online-based platforms or applications that are widely available. Some of them also provide opportunities for crime as this investing activity is known to be done legally or illegally. Especially at this time to disseminate information is very easy by using online media, so that the perpetrators easily promote this illegal stock investment to the public by promising a large profit that is certain. Most people will be tempted by the lure of these huge profits without caring about the risks that come later, which is why the phenomenon of online-based illegal investment has emerged. legal certainty when the legislation is created and promulgated by paying attention to and considering the principle of legal certainty, a clear rule will be realized. The method applied in this legal research is the study of normative juridical research methods, which refers to substance analysis research from laws and regulations, books, journals and papers and other jurisprudence. Normative research is because the research specifications are mostly made on secondary instructions in the library. According to the UUPM, there are several dispute resolutions in online investment on stock investment applications that are rampant and developing today: 1. Settlement by consensus, 2. Settlement through arbitration 3. Settlement through Alternative Dispute Resolution and Settlement Through the Court, where legal protection can be given to investment: Investment Law, Contract Protection, Protection of Ownership Rights, Transparency and Disclosure, Protection against Fraud, Minority Rights, Financial Market Regulation Keywords: Investor Legal Protection, Online Investment Case Settlement
