Abstract

Menciptakan suatu perekonomian mandiri bersama yang berlandaskan asas kekeluargaan demokrasi ekonomi Undang-Undang Dasar Republik Indonesia tahun 1945 dengan peningkatan kemakmuran rakyat yang semakin merata, pertumbuhan ekonomi yang cukup tinggi dan stabilitas nasional yang semakin mantap, perlu didorong oleh pelaku dalam tata perkembangan nasional. Koperasi merupakan gerakan ekonomi rakyat yang dikelola menggunakan asas kekeluargaan dan asas kebersamaan. Koperasi bertujuan memajukan kesejahteraan anggota pada khususnya dan masyarakat pada umumnya, serta ikut membangun tatanan perekonomian nasional. Perkembangan ekonomi nasional dan perubahan yang terjadi lingkungan dunia usaha termasuk didalamnnya adalah unit koperasi, Pada era sekarang ini koperasi memiliki perbedaan prinsip dengan pemikiran yang mendasari terbentuknya koperasi tersebut, pada saat ini koperasi dijadikan sebagai investasi deposito berjangka yang menurut penulis tidak sesuai dengan kaidah ataupun norma serta aturan yang ada di Perkoperasian Indonesia. Perkembangan koperasi saat ini tidak didukung dengan fungsi pengawasannya baik secara internal maupun secara eksternal, yang menjadi fokus penulisan pada tesis ini adalah mengenai peran pengawas eksternal Koperasi Simpan Pinjam (KSP) untuk mencegah terjadinya wanprestasi terhadap anggota KSP dan perlindungan hukum bagi para anggota Koperasi Simpan Pinjam (KSP) yang mengalami kerugian akibat wanprestasi yang dilakukan oleh KSP. Penelitian ini merupakan penelitian normatif, yaitu penelitian yang bersumber dari data sekunder. Data sekunder diperoleh dari bahan hukum primer, sekunder, dan tersier yang dapat memberikan informasi mengenai pengawasan terhadap koperasi simpan pinjam untuk mencegah terjadinya wanprestasi terhadap para anggota Koperasi, Data-data tersebut kemudian dianalisis dan diolah dengan metode kualitatif agar dapat menjelaskan dan memberikan solusi terhadap permasalahan hukum yang dikaji. Hasil penelitian pada penulisan ini Pemerintah pada prinsipnya telah berupaya untuk melakukan pengawasan kepada Koperasi Simpan Pinjam Peraturan untuk mengawasi koperasi ini sebenarnya sudah diatur dari tahun 1992 yaitu setelah lahirnya Undang-undang Nomor 25 Tahun 1992 tentang Perkoperasian sampai dengan tahun 2017 namun tidak ada kepastian hukum yang mengatur secara pasti mengenai pengawas eksternal untuk mengawasi kegiatan KSP dan dibutuhkannya pengawas eksternal untuk mengawasi koperasi yang tidak terbatas pada anggota koperasi./Creating a joint independent economy based on the principle of kinship, economic democracy, the Constitution of the Republic of Indonesia of 1945 with an increase in people's prosperity that is increasingly evenly distributed, high enough economic growth and increasingly steady national stability, needs to be encouraged by actors in the national development system. The development of the national economy and changes that occur in the business world environment include cooperative units, In the current era cooperatives have different principles with the thinking underlying the formation of the cooperative, at this time cooperatives are used as time deposit investments which according to the author are not in accordance with the rules or norms and rules that exist in Indonesian Cooperatives. The development of cooperatives is currently not supported by its supervisory function both internally and externally, the focus of writing this thesis is on the role of external supervisors of Savings and Loan Cooperatives (KSP) to prevent defaults on KSP members and legal protection for members of Savings and Loan Cooperatives (KSP) who suffer losses due to defaults committed by KSP. This research is a normative research, which is research sourced from secondary data. Secondary data are obtained from primary, secondary, and tertiary legal materials that can provide information on supervision of savings and loan cooperatives to prevent defaults on cooperative members, These data are then analyzed and processed with qualitative methods in order to explain and provide solutions to the legal problems studied. The results of research at this writing, the Government has in principle tried to supervise Savings and Loan Cooperatives The regulations to supervise these cooperatives have actually been regulated from 1992, namely after the birth of Law Number 25 of 1992 concerning Cooperatives until 2017, but there is no definite legal certainty regarding external supervisors to supervise KSP activities and the need for external supervisors to supervise cooperatives that is not limited to cooperative members.
