Abstract

Penanaman modal asing merupakan suatu kegiatan substantif bagi perekonomian Republik Indonesia, khususnya dari sektor riil. Salah satu upaya yang dilakukan oleh pemerintah dalam menyelenggarakan infrastruktur khususnya infrastruktur fisik dengan menggunakan sistem investasi baik asing maupun domestik yaitu melalui Penanaman modal asing menggunakan skema “Public Private Partnership” (PPP). Jenis penelitian ini adalah penelitian hukum normatif. Sumber penelitian diperoleh dari mengkaji data sekunder, dengan metode pengumpulan data melalui studi pustaka dan wawancara. Wawancara hanya bersifat pendukung penelitian normatif. Metode pengolahan data dengan rekonstruksi dan sistematisasi data, dengan analisis kualitatif. Public Private Partnership (PPP) sebagai suatu perjanjian atau kontrak antara badan publik dan pihak swasta dimana pihak swasta melakukan fungsi pemerintah untuk jangka waktu tertentu dan pihak swasta menerima kompensasi dalam rangka melakukan fungsi tersebut secara langsung atau tidak langsung. Sistem PPP ini pemerintah dan badan usaha penyedia infrastruktur melakukan perikatan kerjasama secara langsung demi kepentingan masyarakat, dan risiko perikatan tersebut dijamin oleh PT. Penjaminan Infrastruktur Indonesia. Mengapa dipilih model kerjasama tersebut dikarenakan PPP adalah proyek yang sumber dananya berasal dari patungan antara modal dalam negeri dan modal asing, sehingga dapat meneruskan bentuk kerjasama lama yang pernah ada namun dengan sistem yang lebih baik sesuai kontrak kerjasama yang disepakati. Foreign investment is a substantive activity for agriculture of the Republic of Indonesia, specifically from the real sector. One of the efforts made by the government in the implementation of physical infrastructure infrastructure using the investment system both domestically and domestically is through foreign investment by using "Public Private Partnership" (PPP). This type of research is normative legal research. The source of the research was obtained from secondary data, with methods of collecting data through literature studies and interviews. Interviews are only normative research interventions. Data processing method by handling and systematizing data, with qualitative analysis. Public Private Partnership (PPP) as an agreement or contract between a public body and a private party where the private party carries out a government function for a certain period of time and the private party receives compensation in order to perform this function directly or indirectly. This PPP system, the government and business infrastructure providers engage in cooperation agreements directly for the benefit of the community, and the risk of the engagement is guaranteed by PT. Indonesia Infrastructure Guarantee. Why is the cooperation model chosen because PPP is a project where the source of funds comes from a joint venture between domestic capital and foreign capital, so that it can continue the existing form of cooperation but with a better system in accordance with the agreed cooperation contract.
