Abstract

Sistem alih daya di Indonesia merupakan suatu polemik pada pekerja dari tahun ke tahun, khususnya dalam hal perlindungan hukum pekerja dan status hukumnya yang masih kabur diatur pada undang-undang. Pasca diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terdapat perubahan pengaturan terkait alih daya dalam Pasal 64 sampai dengan Pasal 66, yaitu Pasal 64 dan 65 dihapus dalam Undang-Undang Cipta Kerja dan perubahan pengaturan pada Pasal 66. Diketahui bahwa dengan adanya Undang-Undang Cipta Kerja, sistem alih daya tidak lagi diatur terkait pembatasan pekerjaan yang didelegasikan dan jenis perjanjian kerja yang digunakan dalam sistem alih daya masi tidak ada kepastian atau masih sama dengan undang-undang sebelumnya. Rumusan masalah dalam skripsi ini adalah bagaimana akibat hukum bagi pekerja dalam hubungan alih daya dan bagaimana perlindungan dan status hukum pekerja alih daya berdasarkan Undang-Undang Cipta Kerja. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan pada studi dokumen hukum dengan konsep peraturan perundang-undangan, keputusan/ketetapan pengadilan, asas dan prinsip hukum, teori hukum, dan doktrin / pendapat para ahli. Data yang digunakan adalah data sekunder berupa bahan buku primer: Kitab Undang-Undang Hukum Perdata, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Undang-Undang Republik Indonesia Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Undang-Undang Republik Indonesia Nomor 11 Tahun 2020 tentang Cipta Kerja, Peraturan Pemerintah Republik Indonesia Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat dan Pemutusan Hubungan Kerja,Peraturan Pemerintah Republik Indonesia Nomor 35 Tahun 2021 tentang Pengupahan, sedangkan bahan hukum sekunder diperoleh dari buku-buku, maupun literatur lain, jurnal hukum artikel hukum dan tulisan hukum lainnya. Dari hasil penelitian ini dapat disimpulkan bahwa akibat hukum pada hubungan kerja terhadap pekerja alih daya dengan perusahaan alih daya masih sama dengan undang-undang ketenagakerjaan sebelumnya, namun pembatasan pekerjaan yang dialihdayakan tidak lagi diatur klasulnya. Lalu, perlindungan hukum terkait hak-hak pekerja alih daya menjadi tanggung jawab perusahaan alih daya yang sebagaimana dimaksud pada Pasal 66 ayat (1) Undang-Undang Cipta Kerja. Kata Kunci : Pekerja Alih Daya, Cipta Kerja. / The outsourcing system in Indonesia is a polemic for workers from year to year, especially in terms of legal protection for workers and their legal status which is still unclear is regulated by law. After the promulgation of Law Number 11 of 2020 concerning Job Creation, there have been changes to regulations related to outsourcing in Articles 64 to 66, namely Articles 64 and 65 were deleted in the Job Creation Law and changes to regulations in Article 66. It is known that with the existence of the Law -The Job Creation Law, the outsourcing system is no longer regulated regarding restrictions on delegated work and the types of work agreements used in the outsourcing system are still uncertain or are still the same as the previous law. The formulation of the problem in this thesis is what are the legal consequences for workers in an outsourcing relationship and how is the protection and legal status of outsourced workers based on the Job Creation Law. This research is a normative legal research with an approach to the study of legal documents with the concept of laws and regulations, court decisions/decisions, legal principles and principles, legal theory, and doctrine/expert opinion. The data used is secondary data in the form of primary book materials: the Civil Code, the 1945 Constitution of the Republic of Indonesia, the Law of the Republic of Indonesia Number 13 of 2003 concerning Manpower, the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation, Government Regulation of the Republic of Indonesia Number 35 of 2021 concerning Work Agreements for a Specific Time, Outsourcing, Working Time and Break Time and Termination of Employment, Government Regulation of the Republic of Indonesia Number 35 of 2021 concerning Wages, while secondary legal materials are obtained from books , as well as other literature, legal journals, legal articles and other legal writings. This research is a normative legal research with an approach to the study of legal documents with the concept of laws and regulations, court decisions/decisions, legal principles and principles, legal theory, and doctrine/expert opinion. The data used is secondary data in the form of primary book materials: the Civil Code (hereinafter referred to as the Civil Code), the 1945 Constitution of the Republic of Indonesia, the Law of the Republic of Indonesia Number 13 of 2003 concerning Manpower, the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation, Government Regulation of the Republic of Indonesia Number 35 of 2021 concerning Work Agreements for a Specific Time, Outsourcing, Working Time and Rest Time and Termination of Employment, while secondary legal materials are obtained from books, as well as other literature, journals law legal articles and other legal writings.
