Abstract

Indonesia, melalui Kemenkumham melaporkan bahwa jumlah permohonan hak kekayaan intelektual berupa paten sebanyak 10.939 dokumen, serta sertifikat paten yang telah dikeluarkan mencapai 7156 serta jumlah penyelesaian permohonan paten sebanyak 13.790. Apa saja perlindungan hukum bagi para pemegang hak paten berdasarkan UU No 13 tahun 2016 tentang Paten, dan bagaimana upaya hukum yang bisa dilakukan Nokia atas pelanggaran yang dilakukan oleh Oppo? Metode penelitian yang digunakan adalah studi Pustaka, menggunakan data data primer yang terdiri dari peraturan perundang-undangan maupun ketentuan perjanjian internasional, data sekunder yang terdiri dari buku, makalah, jurnal, koran, internet, ataupun bahan bahan ilmiah lainnya, dan data tersier yang mencakup KBBI dan Black Law Dictionary Perlindungan hukum bagi pemegang paten harus tetap sesuai dengan undang undang no 13 tahun 2016 tentang Paten, dan gugatan Nokia terhadap Oppo tidak dapat diterima. Kata Kunci : Paten, Perlindungan Hukum. / Indonesia, through the Ministry of Law and Human Rights, reported that the number of applications for intellectual property rights in the form of patents was 10,939 documents, and the number of patent certificates that had been issued reached 7156 and the number of patent application settlements was 13,790. What are the legal protections for patent holders based on Law No. 13 of 2016 concerning Patents, and what legal remedies can Nokia take for violations committed by Oppo? The research method used is a literature study, using primary data data consisting of laws and regulations and international treaty provisions, secondary data consisting of books, papers, journals, newspapers, the internet, or other scientific materials, and tertiary data which includes KBBI and Black Law Dictionary. Legal protection for patent holders must remain in accordance with Law No. 13 of 2016 concerning Patents, and Nokia's lawsuit against Oppo cannot be accepted. Keywords : Patent, Legal Protection
